事业单位“吃空饷”问题研究

【摘要】:当前,中国经济社会发展过程中,出现了一种很常见的现象,就是“吃空饷”。这种现象的出现,是由于个人、社会和国家之间因为利益而出现的矛盾,个人利用我国法律、制度的不健全,钻制度的空子以获取不正当的收益。这种现象的流行也使得很多人开始不重视法律,影响了社会的公平公正,极大的破坏了政府的公信力,正是由于有些行政行为的缺失,导致了这种现象的出现。本文根据相关报道,并结合某些地区对吃空饷现象的查处来深入分析“吃空饷”现象。当然,不能说各地在查处“吃空饷”时就有徇私舞弊嫌疑,这需要我们从多个方面进行分析,但由于法制观念不强,处理程度较轻,处罚措施过于简单,和监管制度不健全,这些都是“吃空饷”屡禁不绝的根本性原因,也同样是导致“吃空饷”频频发生的原因。文章在分析“吃空饷”现象时,将社会的典型案例和理论研究结合起来,首先给出了“吃空饷”的概念,从三个时期概述了“吃空饷”的溯源,并将“吃空饷”的现象分为六种类型,指出了当前事业单位“吃空饷”现象的特点,结合人事制度改革过程中存在的不足,指明了人事制度的改革发展方向。其次,深入分析了事业单位人员“吃空饷”现象的原因,指出“吃空饷”现象的危害和影响。由于导致“吃空饷”现象频发的因素很多,总结为财政经费支出透明度低,人事管理制度的不规范,公权力的相对集中,监督不力和查处不严等五个方面。最后,与我国事业单位人事管理制度改革的方向和目标进行结合,提出要从源头上解决此类现象的出现,就要从以下三方面入手。制度上从财税审批制度的执行,编制制度的改革来进行治理;监督上要从公众的监督权限和部门的责任监督进行完善;权力上则要从权力的集中度和党风整治进行改善,以此来提出能够提高我国事业单位人事改革的战略和路径。运用已有的理论基础进行分析,提高我国事业单位人事制度改革的措施,针对“吃空饷”现象提出切实可行的监督管理机制和处罚措施。
[Abstract]:At present, China's economic and social development process, there is a very common phenomenon, is "eat empty pay." The appearance of this phenomenon is due to the contradiction between the individual, society and the country because of the interests, the individual makes use of the law of our country, the system is not perfect, and exploits the gap of the system in order to obtain the improper profit. The popularity of this phenomenon also makes many people begin to ignore the law, affect the fairness and justice of the society, greatly undermine the credibility of the government, it is due to the absence of some administrative acts, leading to the emergence of this phenomenon. In this paper, the phenomenon of "eating empty pay" is analyzed in depth according to the relevant reports and the investigation and treatment of the phenomenon of eating empty pay in some areas. Of course, it cannot be said that there is suspicion of favoritism and malpractice in investigating and dealing with "eating empty pay." this requires us to make an analysis from many aspects. However, due to the weak concept of the legal system, the lesser degree of handling, the simplistic punishment measures, and the imperfect regulatory system, These are the fundamental reasons for the repeated prohibition of empty pay, as well as the frequent occurrence of empty pay. When analyzing the phenomenon of "eating empty pay", this paper combines the typical cases of society with the theoretical research, first gives the concept of "eating empty pay", and outlines the source of "eating empty pay" from three periods. The phenomenon of "eating empty pay" is divided into six types, and the characteristics of the phenomenon of "eating empty pay" in institutions are pointed out. Combined with the shortcomings in the reform of personnel system, the direction of reform and development of personnel system is pointed out. Secondly, it analyzes the causes of the phenomenon of "eating empty pay", and points out the harm and influence of the phenomenon of "eating empty pay". There are many factors which lead to the phenomenon of "eating empty pay". It is concluded that the transparency of financial expenditure is low, the personnel management system is not standardized, the public power is relatively centralized, the supervision is weak and the investigation and punishment is not strict. Finally, combining with the direction and goal of the reform of personnel management system in China's institutions, the author points out that to solve this kind of phenomenon from the source, we should start with the following three aspects. Institutionally, the implementation of the fiscal and tax examination and approval system and the reform of the establishment system should be carried out to govern; the supervision should be improved from the supervision authority of the public and the responsibility supervision of the departments; and the power should be improved from the centralization of power and the rectification of the party style. This paper puts forward the strategy and path to improve the personnel reform of public institutions in our country. Based on the analysis of the existing theoretical basis, the measures to improve the reform of personnel system in China's public institutions are analyzed, and the practical supervision and management mechanism and punishment measures are put forward in view of the phenomenon of "eating empty pay".
