行政机关和事业单位职能界定问题研究

【摘要】：改革开放以来,为适应我国经济社会的发展,推进社会主义市场经济体制的不断完善,政府职能转变被提上议事日程。目前我国正处于经济社会转型时期,计划经济时期养成的一些行政习惯在政府职能和行政管理体制中仍然存在,适应市场经济要求的政府职能体系和行政系统尚未完全得以建立。政府职能依然不同程度地存在“错位”、“越位”和“缺位”现象,政府的社会管理和公共服务职能还有待于进一步加强；中央和地方政府职能权限划分不科学,职能界定不清晰,事权承担不匹配,政府部门设立不合理,职责断开和效率不高问题比较突出；政府权力在某些方面过于集中,缺乏有效的监督和约束,个别领导干部滥用职权、贪污和腐败现象仍然存在。因此,科学合理地界定政府职能和设立部门机构,实现政府职能的根本转变,仍然是我国政府机构改革的关键所在。本文首先对国内外关于政府职能问题研究的大量相关文献进行系统梳理,在此基础上,对我国机构职能、行政机关和事业单位职能的概念进行界定；然后对改革开放以米我国机构改革历程做了系统描述；接着对行政机关和事业单位职能现状与问题进行详细阐述,特别是对中央与地方政府职能权限划分、地方政府各部门间的职能界定、政府部门与事业单位职能界定等方面存在的问题做了重点分析；最后从合理划分和依法规范中央与地方政府职能权限、按照市场经济要求界定并调整政府各部门间职能结构、科学界定政事职能并进一步深化行政管理体制改革等若干方面,针对行政机关和事业单位职能界定问题提出了一些具有一定可操作性的意见和建议,以期为我国政府机构改革中的职能界定和事业单位分类改革提供参考和借鉴。本文采用文献研究与社会调查相结合、制度分析与经济分析相结合、实证分析与规范分析相结合的方法,对当前我国行政机关和事业单位职能界定存在的主要问题进行了系统分析,提出了一些具有可行性的解决方案。关于政府职能的研究,目前国内外主要从任务和经济学角度研究其如何发挥作用；而事业单位是我国特有的一种机构,国内研究起步较晚,且主要集中于功能作用的划分等方面。本文研究的核心是行政机关和事业单位的职能重新界定问题,在研究内容上有一定创新。
[Abstract]:Since the reform and opening up, in order to adapt to the economic and social development of our country and to promote the continuous improvement of the socialist market economic system, the transformation of government functions has been put on the agenda. At present, our country is in the period of economic and social transformation, and some administrative habits developed during the planned economic period still exist in the government functions and administrative management system. The government function system and administrative system that adapts to the market economy request has not been completely established. The phenomena of "dislocation", "offside" and "absence" still exist in government functions to varying degrees, the social management and public service functions of the government need to be further strengthened, and the division of the functions of central and local governments is not scientific. The definition of functions is not clear, the responsibilities of government departments are not matched, the establishment of government departments is unreasonable, the problems of disconnection of duties and inefficiency are more prominent, the government power is too centralized in some aspects, and it lacks effective supervision and restriction. Individual leading cadres abuse their power, corruption and corruption still exist. Therefore, it is still the key to the reform of government institutions to define the functions of the government scientifically and rationally, to set up the departments and to realize the fundamental transformation of the functions of the government. Firstly, this paper systematically combs a large number of relevant documents about government function research at home and abroad, on the basis of which, defines the concept of agency function, administrative organ and institution function in our country. Then it systematically describes the course of reform and opening up to the outside world in China, and then expounds in detail the functions and problems of the administrative organs and institutions, especially the division of the functions of the central and local governments. The problems existing in the definition of functions among local government departments, the functions of government departments and public institutions are analyzed emphatically. Finally, the functions of central and local governments are rationally divided and standardized according to law. In accordance with the requirements of the market economy, it defines and adjusts the functional structure of various government departments, scientifically defines the functions of government and government affairs, and further deepens the reform of the administrative management system. This paper puts forward some operable opinions and suggestions for defining the functions of administrative organs and institutions in order to provide reference and reference for the definition of functions in the reform of government institutions and the reform of classification of public institutions. This paper adopts the methods of combining literature research with social investigation, system analysis with economic analysis, and empirical analysis with normative analysis. This paper makes a systematic analysis of the main problems existing in the definition of the functions of administrative organs and institutions in our country, and puts forward some feasible solutions. About the research of government function, at present, domestic and foreign mainly study how to play its role from the angle of task and economics, and the institution is a special institution in our country, and the domestic research starts relatively late. And mainly focused on the functional role of the division and so on. The core of this paper is the redefinition of the functions of administrative organs and institutions.
