中国地方主要官员地域回避制度研究

【摘要】：地域回避制度是中国特定文化和社会环境下产生的一种独特的官员任职制度,它通过禁止担任特定领导职务的国家公职人员在特定地域任职的方式,来达到减少公权力行使中利益冲突的效果。在漫长的封建社会时期,地域回避制度在维护中央集权和防止官员腐败等方面均发挥了积极的作用。目前,各界对地域回避的理解和认识仍然存在较大分歧。地域回避制度规范的对象是中国地方党政机关的主要官员,他们掌握着地方政权中最关键的公权力,直接影响着任职地的经济社会发展走向。因此,考察地域回避制度的运行效果,分析这一制度存在的现实问题,进而提出有针对性的改革完善措施,具有一定的理论意义和现实意义。本文分为四部分:第一部分“导论”,阐述地域回避制度的相关概念,在归纳相关规定的基础上分析了中国地域回避制度的特点;梳理国内外在回避制度尤其是地域回避制度方面相关研究成果的基础上确定了本文的研究方法、框架结构。第二部分“历史沿革”,结合不同时期社会经济发展情况,论述了中国古代、民国时期、建国初期、改革开放以后相关政策的演进。第三部分“现状分析”,结合问卷调查数据,分析了各个社会群体对地域回避的态度和当前中国地域回避制度的正面效果、现实问题及其成因。第四部分“发展趋势与路径选择”,在论证当前社会环境下地域回避制度合理性的基础上,提出了地域回避制度本身完善方案和相关社会环境优化方案,以解决现行地域回避制度造成的诸多问题。最后,对全文的主要结论进行了归纳。
[Abstract]:The system of geographical recusal is a unique system of official appointment in the specific cultural and social environment of China. It prohibits national public officials from holding certain positions of leadership in a specific geographical area. To reduce the conflict of interest in the exercise of public power. During the long period of feudal society, regional avoidance system played an active role in maintaining centralization and preventing official corruption. At present, there are still great differences in understanding and understanding of regional avoidance. The object of the regional avoidance system is the principal officials of the local party and government in China. They hold the most critical public power in the local political power and directly affect the economic and social development trend of the office. Therefore, it is of theoretical and practical significance to investigate the operation effect of the regional avoidance system, to analyze the practical problems existing in the system, and then to put forward targeted reform and perfection measures. This paper is divided into four parts: the first part, "introduction", expounds the relevant concepts of regional avoidance system, and analyzes the characteristics of China's regional avoidance system on the basis of induction of relevant provisions; On the basis of combing the domestic and foreign research results of the avoidance system, especially in the area of regional avoidance system, this paper determines the research method and frame structure. The second part, "Historical evolution", discusses the evolution of relevant policies in ancient China, the Republic of China period, the initial period of the founding of the people's Republic of China, and the reform and opening up period, combined with the social and economic development in different periods. The third part is "current situation Analysis", which analyzes the attitude of various social groups towards regional avoidance and the positive effects of the current system of regional avoidance in China, as well as the practical problems and their causes. The fourth part, "Development trend and path selection", on the basis of demonstrating the rationality of the regional avoidance system under the current social environment, puts forward the perfect scheme of the regional avoidance system itself and the relevant social environment optimization scheme. In order to solve the current regional avoidance system caused many problems. Finally, the main conclusions of the paper are summarized.
