境外非政府组织在华登记注册问题研究
[Abstract]:With the tide of reform and opening up in China, more and more foreign NGOs come to China to seek cooperation and carry out a series of public welfare activities. However, the process of foreign NGOs entering our country has to a certain extent been hindered by various obstacles, whether from the legitimacy identification of the entry into our country, and the running process of the project activities. To the applicable laws and regulations to protect their basic rights and interests, more or less there are some problems. This paper mainly analyzes the problems and reasons encountered by overseas NGOs in the examination of identity access and registration, and puts forward their own views on these problems. The author believes that the main problems in the registration and registration of overseas NGOs in the mainland of China include that the legal system for registration of non-governmental organizations outside China is not yet perfect. The admission examination managed by the civil affairs department lacks the systematic political examination link, some overseas NGOs are registered in the form of enterprises, the nature of the organization is fuzzy and the registration information of the non-governmental organizations outside China is difficult to grasp. The analysis of the causes of these problems is reflected in the dual management system, which restricts the registration and registration of non-governmental organizations outside China, and has concerns about the political influence of non-governmental organizations outside China and the lack of government departments' sense of responsibility to them. In view of the above problems, the author puts forward corresponding countermeasures and suggestions. Including improving the legal system for the registration and management of non-governmental organizations outside China, unifying applications for registration with public security organs, and increasing the links of political examination. Non-political foreign non-governmental organizations may be assisted by the competent business departments in their annual audit work. To establish a national information database of non-governmental organizations outside China, to do a good job in the disclosure and management of registration information, and to strengthen the immigration control of expatriate employees of non-governmental organizations outside China.
