我国政府购买服务中契约责任失效问题研究

【摘要】：政府购买服务中,制度框架内的责任失效包括政府体制内购买、政府非典型性购买、政府逆向购买和制度契约反噬公私主体。政府购买服务的参与主体不能模糊地接受政策制度,而需要对制度规范的合理性进行反思。政府购买服务的参与主体不应当是外在政策制度的傀儡,不应是被动的、机械的接受者,而是能动的、具有伦理判断的理性选择者。当外在的制度所规定的责任关系不合理时,就要对制度本源进行质疑、分析及修订更新。
[Abstract]:In government purchasing service, the failure of responsibility within the framework of system includes government system purchase, government atypical purchase, government reverse purchase and institutional contract counteracting public and private subjects. The participants of government purchase service can not accept the policy system vaguely, but need to reflect on the rationality of system norm. The participating subject of government purchasing service should not be a puppet of external policy system, not a passive, mechanical receiver, but a dynamic and rational choice with ethical judgment. When the responsibility relationship stipulated by the external system is unreasonable, the origin of the system should be questioned, analyzed and revised.
