上海市黄浦区信访问题与对策研究

【摘要】：信访制度是我国社会主义建设过程中的一项具有中国特色的制度。信访,是指公民、法人或者其他组织采用书信、电子邮件、传真、电话、走访等形式,向各级人民政府、县级以上人民政府部门反映情况,提出建议、意见或者投诉请求,依法由有关行政机关处理的活动信访是中国公民享有一项权利,它是公民共同参与国家管理、经济建设、社会事宜和维护自身合法权益的一种重要渠道。随着改革开放以来,城市高速发展,社会经济结构发生改变,贫富差距日益拉大,社会各阶层的矛盾也日显突出,使得信访矛盾成为导致整个社会稳定的重要因素,信访制度面临前所未有的严峻形势。1995年10月,国家推出了首部《信访条例》,规范了各级政府信访工作流程与工作方式等,这意味着中国的信访制度建设已进入一个全新时代。2005年1月,国家根据信访形势的不断变化,不断调整信访工作格局,再次推出新的《信访条例》,进一步加强和完善信访法律制度,并取得了显著成效。目前在信访法制领域,《信访条例》是层级最高,内容最基本的法律,但它只是一部行政法规,在实际工作操作过程中,存在制订不合理的问题。笔者在上海市黄浦区信访办公室工作,是协调解决群众反映的各类纠纷的第一线部门,对各类信访矛盾接触较多,对于在信访工作中产生的种种问题深有感触。目前黄浦区信访工作存在信访机构设置不合理、群众法制观念偏差、信访终结制度落实不到位等情况。针对以上问题,笔者利用岗位优势,通过一定的渠道收集较为详细地黄浦区信访工作情况,并结合国内外“信访”模式经验借鉴,对该区信访工作存在的不足提出解决对策,对上海市黄浦区信访工作具有重要的意义,以此推动上海黄浦区信访工作更好发展。
[Abstract]:The system of letters and visits is a system with Chinese characteristics in the process of socialist construction in China. "letter and visit" means that citizens, legal persons or other organizations report the situation to the people's governments at or above the county level by letter, e-mail, fax, telephone, visit, etc., and submit suggestions, opinions or requests for complaints, It is an important channel for Chinese citizens to participate in state administration, economic construction, social affairs and safeguard their legitimate rights and interests. With the rapid development of the city since the reform and opening up, the social and economic structure has changed, the gap between the rich and the poor has been widening day by day, and the contradictions among various social strata have become increasingly prominent, making the contradiction between letters and visits an important factor leading to the stability of the whole society. In October 1995, the state introduced the first "regulations on Letters and visits", which standardized the work flow and working methods of the governments at all levels. This means that the construction of China's petition system has entered a new era. In January 2005, according to the constant changes in the situation of letters and visits, the state constantly adjusted the work pattern of letters and visits, and again introduced the new "regulations on Letters and visits". To further strengthen and improve the legal system of letters and visits, and achieved remarkable results. At present, in the field of petition legal system, "petition regulations" is the highest level, the most basic law, but it is only an administrative law, in the actual operation process, there is an unreasonable problem. The author works in the office of letters and visits in Huangpu District of Shanghai, which is the first line department to coordinate and resolve all kinds of disputes reflected by the masses, and has more contact with the contradictions of various letters and visits, and has deep feelings about the problems arising in the work of letters and visits. At present, the work of letters and visits in Huangpu District has some problems, such as unreasonable setting of petition organizations, deviation of legal concepts of the masses, and inadequate implementation of the system of termination of letters and visits. In view of the above problems, the author makes use of the post superiority, collects in detail the Huangpu area letter and visit work situation through certain channels, and combines the domestic and foreign "letter and visit" pattern experience to draw lessons, and puts forward the solution countermeasure to the district letter and visit work insufficiency, It is of great significance to Huangpu District, Shanghai, so as to promote the better development of Shanghai Huangpu District.
