制度-结构-能力:我国社区自治的三维建设框架

【摘要】：社区自治是基层治理机制创新的重要组成部分,如何整合社会力量,激活社区自治力量是社区治理的关键问题。运用制度主义分析范式,结合案例分析方法梳理我国社区自治存在的问题,提出解决方案,并分析其潜在的逻辑。研究发现:深圳L区社区治理的实践案例为我国城市社区自治提供了一条有效路径,依法治理,明晰治理主体权责边界,营造社区自治制度环境;结构整合,重塑社区居委会职能、整合社区自治力量;赋权增能,丰富居民参与社区治理的途径,提高居民参与议事能力。研究认为:以"制度-结构-能力"(System-Structure-Capacity)为三维治理框架,通过宏观层面的法治制度设计、中观层面的治理结构整合,以及微观层面的参与者能力建设,保障社区自治的长期存续。这种路径的潜在逻辑在于进行社区自治需要处理好权威治理和有效治理的关系,以及作为治理责任主体的"条块"之间的关系,并在"国家主导的社会治理"逻辑下重塑政社关系,整合多元主体参与社区治理实践。
[Abstract]:Community autonomy is an important part of the innovation of grass-roots governance mechanism. How to integrate social forces and activate community autonomy is the key issue of community governance. By using the paradigm of institutionalism and case analysis, this paper combs the existing problems of community autonomy in China, puts forward solutions and analyzes its potential logic. It is found that the practice case of community governance in L District of Shenzhen provides an effective way for the autonomy of urban communities in China, which can be governed by law, clarify the boundaries of the authority and responsibility of the main body of governance, and create the institutional environment of community autonomy. Structure integration, remolding the function of community neighborhood committee, integrating community autonomy, empowering, enriching residents' ways to participate in community governance, improving residents' ability to participate in deliberations. It is concluded that "institutional-structure-ability" (System-Structure-Capacity) is taken as the three-dimensional governance framework, and through the design of the rule of law system at the macro level, the integration of the governance structure at the meso-level, and the capacity-building of the participants at the micro level. The long-term survival of community autonomy is guaranteed. The underlying logic of this path lies in the need to deal well with the relationship between authoritative governance and effective governance, as well as the relationship between "strips" as the subject of governance responsibility. Under the logic of "state-led social governance", the relationship between government and society should be remoulded, and multiple subjects should be integrated into the practice of community governance.
