论诱发公务不作为的制度缺陷及其改进

【摘要】:不作为是一种较常见的公务违法现象,需要针对其产生的主客观因素进行系统治理。不作为的生成除了公务人员自身的主观因素之外,相关制度的缺陷也是不容忽视的重要客观因素。如重事后问责轻防范监督的制度缺陷、原初责任配置的科学性欠缺、责任追究制度的非公平合理性等,都可能诱发公务人员不作为。对此必须进行系统性的制度改进,主要包括:建立重在事前防范和事中监督的专门制度、科学配置公务岗位职责、构建公平合理的责任追究机制等。
[Abstract]:Omission is a common phenomenon of official violation, which needs to be dealt with systematically according to its subjective and objective factors. Besides the subjective factors of the public servants, the defect of the relevant system is also an important objective factor that can not be ignored. Such as the system defect of emphasizing accountability after the event, the lack of scientific allocation of the original responsibility, the unfairness and rationality of the accountability investigation system, all these may lead to the inaction of the public servants. It is necessary to carry out systematic system improvement, including: establishing a special system focusing on pre-prevention and supervision, scientific allocation of duties and responsibilities of official posts, establishment of a fair and reasonable mechanism of accountability, and so on.
