未成年人犯罪预防的德育对策研究

【摘要】:未成年人犯罪是衡量未成年人道德行为的标准。2008年以来,我国未成年人犯罪人数呈逐年下降趋势,反映了我国未成年人道德素质稳步上升。但近几年校园暴力频发的事实也警醒我们未成年人的道德状况远没有我们想象的美好。德育是有效地提高未成年人道德素质的方式。本文以教育学理论为基础,借鉴犯罪学、法学、伦理学等学科知识,对未成年人犯罪、德育的概念进行了界定,分析了未成年人犯罪的特点和德育的功能,分析了德育介入未成年人犯罪的必要性与可能性,找出了当前德育存在的问题及其原因,提出了未成年人犯罪预防的德育对策。本文除绪论外由四章组成。绪论主要介绍了研究背景、目的和意义,以及研究的思路和方法,述评了国内外研究现状及发展趋势。第一章未成年人犯罪预防的德育对策概述。主要根据预防未成年人犯罪的目的界定了未成年人犯罪及德育的概念,分析了未成年人犯罪的特点和德育的功能。第二章德育介入未成年人犯罪预防的必要性与可能性。刑罚是有效的犯罪预防手段。但是犯罪的多因性决定了刑罚预防犯罪的有限性。此外,刑罚还可能导致多方面的消极效果,甚至引发新的犯罪。对未成年人犯罪来说,监禁刑绝大多数都是短期监禁,刑罚的弊端更为明显。而且,由于未成年人身心发展的不成熟性,刑罚对未成年人消息作用还可能产生泛化的作用。所以,德育是刑罚之外的有效的未成年人犯罪预防手段。第三章未成年人德育的现状。当前我国未成年人德育取得了很大的成绩,未成年人道德素质不断提高。但也存在着德育实效性不足、针对性不强的问题。这主要是由德育理念偏差、德育内容陈旧、德育方法落后、道德环境的不良影响及家庭、学校、社会没有形成合力所造成的。第四章未成年人犯罪预防的德育对策。通过德育预防未成年人犯罪必须加强未成年人德育。加强未成年人德育首先要转变德育理念,树立未成年人主体地位和以人为本的德育理念。同时,还有不断丰富德育内容、变革德育方法、优化未成年人德育的家庭、学校和社会环境。此外,还要充分利用网络技术实现家庭、学校、社会德育的良性互动。
[Abstract]:Juvenile delinquency is the standard to measure the moral behavior of minors. Since 2008, the number of juvenile delinquency in China has been decreasing year by year. It reflects the steady rise of the moral quality of the minors in our country. But the fact that the campus violence occurs frequently in recent years also reminds us that the moral condition of the minors is far less beautiful than we imagined. Moral education is an effective way to improve the morality of the minors. Based on pedagogy theory, Based on the knowledge of criminology, law and ethics, this paper defines the concepts of juvenile delinquency and moral education, and analyzes the characteristics of juvenile delinquency and the function of moral education. This paper analyzes on the necessity and possibility of moral education intervention in juvenile delinquency, and finds out the existing problems and causes of moral education. This article consists of four chapters except the introduction. The introduction mainly introduces the background, purpose and significance of the research, as well as the ideas and methods of the research. This paper reviews the current research situation and development trend at home and abroad. The first chapter summarizes the moral education countermeasures for the prevention of juvenile delinquency, mainly defines the concept of juvenile delinquency and moral education according to the purpose of preventing juvenile delinquency. This paper analyzes the characteristics of juvenile delinquency and the function of moral education. Chapter two: the necessity and possibility of moral education intervention in the prevention of juvenile delinquency. Punishment is an effective means of crime prevention. The limitation of crime prevention. Penalties can also lead to many negative effects, and even lead to new crimes. For juvenile delinquents, the vast majority of prison sentences are short-term imprisonment, and the disadvantages of the penalty are more obvious. Because of the immature nature of minors' physical and mental development, punishment may also have a generalized effect on the information of minors. Moral education is an effective means to prevent juvenile delinquency in addition to punishment. Chapter three is the present situation of moral education for minors. At present, great achievements have been made in the moral education of minors in our country. The moral quality of minors is constantly improved. However, there are also the problems of insufficient effectiveness and weak pertinence of moral education. This is mainly due to the deviation of moral education idea, the outmoded content of moral education, the backward moral education methods, the negative influence of moral environment and the influence of family and school. The moral education countermeasures of the prevention of juvenile delinquency in Chapter 4th. To prevent juvenile delinquency through moral education, we must strengthen the moral education of minors. In order to strengthen moral education of minors, it is necessary to change the concept of moral education in the first place. At the same time, we can enrich the content of moral education, reform the methods of moral education, optimize the family, school and social environment of moral education of minors. We should make full use of network technology to realize the positive interaction of family, school and social moral education.
