教育行政听证制度研究

【摘要】:随着改革开放进程的不断深入,我国正处在一个社会文明飞速发展的时代。强国必先强教,百年大计,教育为本,社会的进步要以教育的科学发展为基础。教育的发展方向一般是由政府制定的教育政策所决定的,而教育政策的制定从根本上讲是一个政府做出教育行政决策的过程和结果,故真正决定一个国家教育发展的是政府做出的教育行政决策。所以,教育行政决策的科学程度直接影响着国家教育发展的合理程度。 本文旨在于教育行政决策程序环境中构建听证制度,在充分论证教育行政听证制度在我国建立和施行的必要性与可行性的基础上,从教育行政听证的事由制度、主体制度、程序制度和效力制度四个方面进行构建并形成教育行政听证制度体系,以解决我国教育行政决策领域存在的缺乏民主机制、决策过程缺乏科学性等问题。 本文从听证活动的起源、发展及其在立法、行政处罚、价格制定等领域的应用出发,运用逻辑分析、系统构建、建立模型等方法进行教育行政听证制度体系构建,最后结合具体案例将教育行政听证制度应用于实际。最后形成了具有逻辑分析、系统分析,又有模型建立、案例解析的理论与实践相结合的成果。 一、对教育行政听证制度概念进行界定并对听证的起源、发展及其法理基础、在行政领域的应用进行梳理,为整个研究建立基础和框架。 二、对教育行政听证制度在我国教育行政决策领域建立和施行进行必要性和可行性分析。其中,在必要性分析中认为建立教育行政听证制度是实现教育公平的必要途径,是教育行政决策发展的必然结果;在可行性分析中从教育行政听证制度建立的社会环境、相关法律规定及其成本优势进行论述,最终得出教育行政听证制度在我国建立具有必要性和可行性的结论。 三、进行教育行政听证制度体系构建。制度体系分为四个子制度:事由制度、主体制度、程序制度和效力制度。其中,事由制度主要对教育行政听证事件进行识别和处置;主体制度主要对各听证主体的职权、义务和遴选进行规范,并建立教育行政听证参与人构成比例分配模型,确定了主体制度的运作流程;程序制度主要从操作层面依照时间序列对教育行政听证会(正式或非正式)运作的流程进行规范;效力制度主要对听证结果的效力进行规范,并提出媒体监管方案对听证过程效力进行保障。 四、对辽宁省物价局于2007年1月18日举行的高校学分制收费决策听证会进行案例分析。在对听证会资料的充分收集及整理的基础上,依据听证会举办的背景和基本情况,以教育行政听证制度体系为规范,客观地从事由、主体、程序和效力四个方面对听证会进行分析,并给出建议。
[Abstract]:With the deepening of the process of reform and opening to the outside world, China is in an era of rapid development of social civilization. The powerful country must first strengthen education, a hundred years, education is the base, and the progress of the society should be based on the scientific development of education. The development direction of education is generally determined by the educational policy formulated by the government, and the formulation of education policy is fundamental. It is the process and result of a government decision making of educational administration, so the government makes a decision on educational administration that really determines the development of a country. Therefore, the scientific degree of educational administrative decision directly affects the reasonable degree of the national education development.
The purpose of this paper is to construct the hearing system in the environment of administrative decision-making procedure. On the basis of fully demonstrating the necessity and feasibility of the establishment and implementation of the educational administrative hearing system in our country, the system, the main body system, the procedural system and the effectiveness system of the educational administrative hearing are constructed and formed in four aspects, and the administrative hearing system of education is formed. In order to solve the problems of lack of democratic mechanism and lack of scientific decision-making in the field of educational administration decision-making in China.
From the origin and development of the hearing activities and its application in the fields of legislation, administrative punishment, and price formulation, this paper uses logical analysis, system construction and model establishment to construct the system of educational administrative hearing system. Finally, the system of educational administrative hearing is applied to practice in combination with specific cases. Finally, a logical analysis has been formed. System analysis, the establishment of models, and the combination of the theory and practice of case analysis.
First, it defines the concept of the educational administrative hearing system and the origin, development and legal basis of the hearing, combs the application of the administrative field, and establishes the foundation and framework for the whole research.
Two, the necessity and feasibility of the establishment and implementation of the educational administrative hearing system in the field of educational administrative decision-making in China are analyzed. In the analysis of the necessity, it is considered that the establishment of the administrative hearing system of education is a necessary way to realize the fairness of education and the inevitable result of the development of educational administrative decision. The social environment established by the certificate system, the relevant legal provisions and their cost advantages are discussed, and finally the conclusion that the educational administrative hearing system is established in China is necessary and feasible.
Three, the system of educational administrative hearing system is constructed. The system system is divided into four sub systems: the system, the main body system, the procedural system and the effectiveness system. Among them, the system mainly identifies and disposes of the administrative hearing events of the educational administration, and the main system is mainly to standardize the powers, duties and selection of the hearing owners and establish the teaching system. The proportion distribution model of the participants in the administrative hearing is constituted, and the operation process of the main body system is determined. The procedural system mainly regulate the process of the operation of the educational administrative hearing (formal or informal) from the operational level according to the time series; the effectiveness system mainly standardize the effectiveness of the hearing results, and put forward the media supervision scheme. The effectiveness of the hearing process is guaranteed.
Four, a case analysis of the decision hearing of the credit system of colleges and universities held in January 18, 2007 by the Liaoning Provincial Bureau of prices is analyzed. On the basis of the full collection and arrangement of the hearing information, according to the background and basic situation of the hearing, the system of educational administrative hearing system is standardized, and the subject, the main body, the procedure and the effectiveness are four. An analysis of the hearing is made and suggestions are given.
