高校学生隐私权保护中存在的问题与对策探析

【摘要】：对于公民来讲,隐私权是一项最为基本的权利,大学生作为一个社会特殊群体,对于隐私权的关注更高,他们更加注重对于隐私权的保护,同时,对于侵犯隐私权的行为存在较大的抵触。然而,目前我国高校管理模式仍然比较滞后。在这种背景下,本文重点研究国内高校在大学生隐私权保护问题及相应的解决对策。本文主要运用访谈和问卷调查的方式从大学生隐私权的内涵和特征、大学生隐私权与高校公开管理的冲突以及高校学生隐私权保护的现状等几个方面分析了高校学生隐私权保护的现实性和必要性。最后,从法律制度、体制机制保护、法律意识和主体意识以及救济途径建设等五个方面来探究高校加强学生隐私权保护的对策与建议。
[Abstract]:For citizens, the right to privacy is the most basic right. As a special social group, college students pay more attention to the right of privacy, they pay more attention to the protection of the right of privacy, at the same time, However, the management mode of colleges and universities in China is still lagging behind. Under this background, this paper focuses on the protection of the privacy of college students in China and the corresponding solutions. This paper mainly uses interviews and questionnaires to analyze the connotation and characteristics of college students' right to privacy. This paper analyzes the reality and necessity of college students' privacy protection from the aspects of the conflict between college students' privacy right and the open management of colleges and universities, as well as the present situation of college students' privacy protection. This paper probes into the countermeasures and suggestions of strengthening the protection of students' right to privacy in the five aspects of legal consciousness and subjective consciousness as well as the construction of relief ways.
