我国宪法“体育权利”的文本表述与制度实现

【摘要】：采用文献资料法等对我国宪法中"体育权利"的表述及其制度实现进行研究。主要结论:我国宪法并没有明确规定"体育权利"为一项公民的基本权利。但是,宪法中有关体育的内容散见于第一章总纲、第二章公民的基本权利和义务、第三章国家机构中的部分条款,"体育权利"隐藏于这些宪法条文之中。宪法多个章节涉及"体育"的条文共同构成了一项相对完整的"体育权利"表述。在这个基础上,我们可以认为"体育权利"是宪法规定的"准基本权利"。作为"准基本权利"的体育权利,其实现有赖于国家义务。现阶段,"体育权利"的实现存在诸多不足,构建制度化的"体育权利"保障体系具有十分重要的现实意义。
[Abstract]:This paper studies the expression of "sports right" in Chinese Constitution and its system realization by using the method of literature and materials. Main conclusion: the constitution of our country does not explicitly stipulate "sports right" as a citizen's basic right. However, the contents of the Constitution concerning sports are scattered in the general outline of chapter one, the basic rights and duties of citizens in chapter two, and the provisions of the state institutions in chapter three, "the right to sport" hidden in these constitutional provisions. Several chapters of the Constitution on sports constitute a relatively complete statement of sports rights. On this basis, we can think that the "sports right" is a constitutional "quasi-basic right." As a quasi-basic right, the realization of sports rights depends on the obligations of the state. At present, there are many deficiencies in the realization of "sports right", and it is of great practical significance to construct an institutionalized "sports right" guarantee system.
