体育赛事定价中的主体商谈与权利实现

【摘要】:体育赛事定价问题的出现既表现出我国体育市场化的不成熟,又表现出我国体育市场法治建设的滞后。体育赛事定价的盈利性、独断性、肆意性超越了其应有的社会性、参与性和合法性,造成关联主体价格权利的保护失位,最终影响体育赛事经营者和体育赛事本身的可持续发展。在经济民主和商谈民主的语境下,体育赛事定价应当从话语、场域和规则的建设出发,落脚于主体权利的实现,在"权利-义务-责任"的框架内寻求体育赛事价格活动的有序开展。经营者、消费者和政府在体育赛事定价商谈中扮演了不同的角色,而消费者权利应当成为定价商谈的重中之重。通过公共领域代表制度和听证制度,可以尝试进行制度拟制,促进体育赛事定价领域的商谈民主形成。
[Abstract]:The emergence of the pricing problem of sports events not only shows the immaturity of sports marketization in our country, but also shows the lag of the construction of rule of law in our country's sports market. The profitability, arbitrariness and arbitrariness of the pricing of sports events exceed its due social, participatory and legitimacy, resulting in the loss of the protection of the price rights of the related parties. Finally, it will affect the sustainable development of sports event operators and sports events themselves. In the context of economic democracy and negotiation democracy, the pricing of sports events should be based on the construction of discourse, field and rules, and should be based on the realization of the right of the subject. In the framework of "right-duty-responsibility" to seek the orderly development of the price activities of sports events. Operators, consumers and the government play a different role in the negotiation of the pricing of sports events, and consumer rights should be the top priority of the pricing negotiations. Through the public field representative system and the hearing system, we can try to establish the system and promote the democratic formation of negotiation in the field of sports event pricing.
