中国篮协的法律地位探究

【摘要】：由于多年来行政体制和思维观念的原因,中国篮协等单项体育协会在我国的法律性质和地位都不甚明确,跟体育行政部门的关系也混乱不清。相关的法律、法规以及内部的章程、制度都很不健全。一直以来对体育市场化和运动规律的尊重、认识不够以及对于行业协会的定义与发展的落后使这些问题更不易探讨和解决。为此,本文特针对中国篮协的法律地位进行探究,并对于此问题的完善给出一些思考和建议。本文包括绪论、正文、结论三部分,其中正文主要内容如下:第一章:主要是中国篮球协会的基本情况概述,介绍了中国篮协产生的根源和背景、中国篮协的发展、中国篮协的宗旨、目标和职责以及中国篮协的权力来源。第二章:在探讨中国篮球协会法律地位现状的前提下,重点分析了相关的法律、法规的规定、存在的一些问题以及造成这些问题的背后原因。第三章:中国篮协法律地位重新定位的理论背景和国外相关的经验介绍,重点介绍了政府失灵理论、市场失灵理论以及一些相关的法学理论,同时对国外在篮球协会法律性质和地位的界定以及相关的经验方面进行了分析。第四章:根据中国篮球协会等单项体育协会发展的理论与制度诉求,结合当前形势与社会发展对中国篮协法律地位的重新定位以及相关制度和法律、法规等方面的完善进行了研究和探讨。
[Abstract]:Because of the reasons of the administrative system and the thinking concept for many years, the legal nature and status of the individual sports associations such as the Chinese Basketball Association are not very clear in our country, and the relationship with the sports administrative department is not clear. The relevant laws, regulations and the internal rules and regulations are not sound. Because of the respect of the market and the law of sports, the lack of understanding and the lag of the definition and development of the trade association make these problems more difficult to discuss and solve. To this end, this article probes into the legal status of the Chinese Basketball Association, and gives some thoughts and suggestions to the improvement of this problem. This paper includes the introduction, the text, the conclusion three parts, in which the main contents of the text are as follows: Chapter one: The main contents of the Chinese Basketball Association are as follows: the origin and background of the Chinese Basketball Association, the development of the Chinese Basketball Association, the purpose of the Chinese Basketball Association, The target and responsibility, as well as the power source of the China Basketball Association. In the second chapter, on the premise of discussing the status of the legal status of the Chinese Basketball Association, the paper analyzes the relevant laws and regulations, some problems and the causes of these problems. The third chapter: the theoretical background of the re-positioning of the legal status of the Chinese Basketball Association and the relevant experience in the foreign countries, and mainly introduces the theory of government failure, the theory of market failure and some relevant legal theories. At the same time, the author makes an analysis on the definition of the legal nature and status of the basketball association and the related experience. Chapter four: According to the theory and system demand of the development of the individual sports associations, such as the Chinese Basketball Association, the author studies and discusses the improvement of the legal status of the Chinese Basketball Association and the related systems and laws and regulations in the light of the current situation and the social development.
