实习生权益保障研究

【摘要】：实习生权益保护不到位的问题日显突出。笼统地将实习生归入劳动法调整并不能解决问题,甚至会适得其反,进一步伤害实习生的基本权益。正确的做法应是从实习活动的人身性、财产性和教育性入手,分别确定法律的切入角度、方式和责任主体,协调劳动法、教育法和职业教育法甚至侵权责任法来共同规范,政府亦应起到牵头协调作用,方能既保护实习生的核心权益,也不损伤企业提供实习机会的积极性。
[Abstract]:The problem of inadequate protection of interns' rights and interests is becoming more and more prominent. General classification of interns into the adjustment of labor law will not solve the problem, or even counterproductive. Further harm to the basic rights and interests of interns. The correct approach should be from the practice of personal, property and education, respectively determine the perspective of the law, the way and responsibility of the main body, to coordinate the labor law. Education law and vocational education law and even tort liability law should also play a leading role in coordination so as to protect the core rights and interests of interns and not damage the enthusiasm of enterprises to provide internship opportunities.
