多中心治理理论视角下的市场主体信用监管研究

【摘要】:在我国社会主义市场经济的发展过程中,市场主体信用体系建设是市场经济最重要的制度保障之一,信用始终贯穿于整个市场交易过程,是市场经济的基石。良好的信用使市场主体具有持久的竞争力,而信用缺失将会引发一系列问题,降低市场主体信誉,增加交易成本,反过来阻碍市场主体自身的发展。当前我国对市场主体信用缺乏有效的监管,导致各类失信行为频发,成为经济发展的一颗“定时炸弹”,时刻威胁着我国经济的平稳有序发展。本文从我国市场主体信用现状和已有的治理情况出发,结合近些年来国内外学者的研究成果,得出我国市场主体信用监管存在的问题,包括信用业发展不平衡、法律法规不完善、政府监管错位、征信制度建设滞后和数据互通和信息标准化缺失等五方面问题,同时还分析了信用缺失导致的危害以及造成信用缺失的原因。本文借以多中心治理理论探讨对市场主体信用监管的新做法,即以政府、市场主体、第三方组织及社会监督等其他力量共同参与、协同治理,抛弃当前政府为主实行监管的模式,以文献研究、比较研究等方法为主,分析我国市场主体信用多中心治理的必要性和可行性,分别研究美国、欧盟、日本为代表的三类不同的信用监管发展过程,借鉴国外的经验教训,结合我国实际,提出我国市场主体信用监管的多中心治理对策,即政府部门要转变角色、统一监管部门并建立健全相关规章制度,规范信用相关机构的服务、实行信用分级制度、加强自我监督,改革行业协会制度、促进研究机构对接实际,引入社会公众监督和舆论监督,培育信用文化等对策来完善我国的市场主体信用治理。
[Abstract]:In the course of the development of socialist market economy in our country, the construction of credit system of market subject is one of the most important institutional guarantee of market economy. Credit always runs through the whole market transaction process and is the cornerstone of market economy.Good credit makes the main body of the market have lasting competitiveness, but the lack of credit will lead to a series of problems, reduce the credibility of the main body of the market, increase transaction costs, and in turn hinder the development of the main body of the market itself.At present, the lack of effective supervision on the credit of the market subject in our country leads to the frequent occurrence of various kinds of dishonest behavior, which has become a "time bomb" for economic development and threatens the steady and orderly development of our country's economy at all times.Based on the present situation of credit of market subject and the existing situation of governance in our country, combined with the research results of domestic and foreign scholars in recent years, this paper points out the problems existing in credit supervision of market subject in our country, including the unbalanced development of credit industry.There are five problems, such as imperfect laws and regulations, malposition of government supervision, lag of credit system construction, lack of data exchange and standardization of information, etc. At the same time, the paper also analyzes the harm caused by the lack of credit and the causes of the lack of credit.Based on the theory of multi-center governance, this paper discusses the new methods of credit supervision of market main body, that is, the government, market main body, third party organization and other forces, such as social supervision and so on, participate together and cooperate in governance.By abandoning the current mode of government supervision, focusing on literature research and comparative research, this paper analyzes the necessity and feasibility of multi-center governance of credit among market players in China, and studies the United States and the European Union, respectively.The development process of three different types of credit supervision represented by Japan, using the experience and lessons of foreign countries for reference, combining with the reality of our country, puts forward the multi-center governance countermeasures of credit supervision of market main body in our country, that is, government departments should change their roles.To unify regulatory departments and establish and improve relevant rules and regulations, standardize the services of credit-related institutions, implement credit grading systems, strengthen self-supervision, reform the system of trade associations, and promote research institutions to connect with practice.Introducing social public supervision and public opinion supervision, cultivating credit culture and other countermeasures to improve the credit governance of market subjects in China.
