综合执法体制和提升食药监管能力的困境

【摘要】：2014年以来,一些地方推行综合执法改革,将工商、质监、食药等部门整合为市场监管局。那么综合执法体制能否提升食品药品监管能力呢?基于政府能力理论和监管质量理论,构建"目标—结构—行为"分析框架,实证探讨体制对能力的作用机理。研究表明,省市县三级改革不同步导致政策目标内生冲突,监管事权与监管力量形成纵横结构性错配,综合执法稀释专业监管行为。可见综合执法体制增加了食药监管资源但削弱了监管能力。据此提出体制改革战略化、事权划分科学化、监管队伍专业化三项政策建议。
[Abstract]:Since 2014, a number of localities have introduced comprehensive law enforcement reforms that have integrated industry and commerce, quality supervision, and pharmaceuticals into a market regulator. Can the comprehensive law enforcement system enhance the ability of food and drug supervision? Based on the theory of government capacity and the theory of regulatory quality, this paper constructs an analytical framework of "goal-structure-behavior", and explores the mechanism of institutional action on capacity. The study shows that the three levels of reform of provinces, cities and counties lead to the endogenous conflict of policy objectives, the structural mismatch between supervision power and supervision force is formed, and the comprehensive law enforcement dilutes the professional supervision behavior. It can be seen that the comprehensive law enforcement system increases the resources of food and drug supervision but weakens the ability of supervision. Based on this, three policy suggestions are put forward: strategic reform of system, scientific division of administrative power and specialization of supervisory team.
