深圳市商事主体的监管研究

【摘要】:深圳商事主体登记改革使得商事主体的设立门槛降低,随之而来的商事主体数量的井喷式增长对商事主体的监管带来了新的挑战,市场主体呈现多元化,市场运作模式复杂多样。在对深圳市场主体的日常监管中发现,深圳市食品安全问题屡禁不止、部分企业唯利是图不讲诚信、不少驰名品牌被制假售假者“傍名牌”。为深圳市市场经济保驾护航的市场监督部门在履职到位上面临严峻挑战,由于群众的法律意识、执法人员的执法水平以及体制机制问题导致在监管过程中监管手段匮乏,监管力度薄弱,监管效果不理想。为了更好的找出深圳市商事主体监管存在的症结,本文借鉴发达国家市对市场监管的成功经验,进一步分析深圳市商事主体“监管难”的根源,优化解决方案。本文从概念释义出发,通过对市场监管面临外部原因分析,提出与时俱进的解决方案;通过分析内部原因,从人员配备、完善制度的角度出发,统筹三个方面来健全深圳市商事主体的质量监管、效率监管机制:一是在监管资源配置方面,建议深圳市市场监管委重心下调,由人事处牵头优化机构调整,人力、物力、财力向监管基层倾斜;二是在监管方式方面,通过优化传统网格及“双随机”监管,加强信用监管;三是在处理外部关系方面,要积极跟地方政府联动执法,提高执法效力,树立深圳市市场监管的执法权威。通过种种努力,使得肩负执法任务的基层监管所和各业务科室,积极的履职到位,完善好商事主体监管工作的最后一环,维护市场经济秩序,保障深圳经济的健康有序的发展。
[Abstract]:The reform of commercial subject registration in Shenzhen has lowered the threshold for the establishment of commercial subject. The following blowout growth in the number of commercial subjects has brought new challenges to the supervision of commercial subjects and diversified market subjects. The market operation model is complex and diverse. In the daily supervision of the main body of the Shenzhen market, it is found that the food safety problems in Shenzhen are not forbidden, some enterprises are profit-seeking and not honest, and many well-known brands are faked, sold and sold "near famous brands". The market supervision departments that provide escort for the market economy in Shenzhen are facing severe challenges in carrying out their duties. Due to the legal consciousness of the masses, the law enforcement level of law enforcement personnel and the problems of the system and mechanism, the supervision means are lacking in the process of supervision. Weak supervision, supervision effect is not ideal. In order to better find out the crux of the supervision of commercial subject in Shenzhen, this paper draws lessons from the successful experience of market supervision in developed countries, further analyzes the root cause of the "difficult supervision" of commercial subject in Shenzhen, and optimizes the solution. Starting from the concept interpretation, through the analysis of the external reasons of the market supervision, this paper puts forward the solution of keeping pace with the times, through the analysis of the internal reasons, from the point of view of staffing, perfecting the system, Coordinating three aspects to improve the quality supervision and efficiency supervision mechanism of commercial subjects in Shenzhen: first, in terms of the allocation of regulatory resources, it is suggested that the focus of the Shenzhen Market Supervision Committee should be lowered, and the personnel Department should take the lead in optimizing the organization's adjustment, manpower and material resources. Financial resources are tilted towards the grass-roots level of supervision; second, in terms of regulatory methods, credit supervision should be strengthened by optimizing the traditional grid and "double random" supervision; third, in dealing with external relations, it is necessary to actively cooperate with local governments to enforce the law and improve the effectiveness of law enforcement. Establish the law enforcement authority of market supervision in Shenzhen. Through all kinds of efforts, we can make the grass-roots supervision offices and business departments that shoulder the task of enforcing the law to carry out their duties actively, perfect the last part of the supervision work of commercial subjects, safeguard the order of market economy, and ensure the healthy and orderly development of Shenzhen's economy.
