我国工程咨询业资质管理制度市场化的改革研究

【摘要】：随着我国建筑市场的开放和发展,工程咨询企业从无到有,并且在建设项目实施的每个阶段起到的作用越来越重要,于是政府为了加强对该行业的监督和管理,维护市场秩序建立了工程咨询企业资质管理制度,其根本实质是指相关建设行政主管部门对从事咨询活动有关企业的基本条件、管理水平、资金数量、技术水平等进行审查以确定其承担任务的范围,从而发给相应的资质证书以保证工程项目质量的一种制度。然而随着工程咨询行业的迅速发展,尤其是2017年全国两会(中国人民政治协商会议第十二届全国委员会第五次会议和中华人民共和国第十二届全国人民代表大会第五次会议)期间重点提出,“我国现在正处在转型阶段,深化‘放管服’改革,坚决破除各方面的机制弊端,简政放权,推动政府职能的重塑,实现市场决定资源配置”的政策意见,我国更是处于形成“统一开放、竞争有序”市场体系的关键阶段,市场经济蓬勃发展,一切知识、劳动、技术、管理和资本等建筑生产要素的活力竞相迸发,以致我国工程咨询业资质管理制度的局限性越来越明显。首先,我国工程咨询企业实行以企业资质为主的管理制度,企业资质涉及勘查资质,设计资质,监理资质,造价咨询资质等众多分类,名目繁多,条块分割过细,导致企业资质管理极为复杂,咨询行业发展困难;其次,公司资质挂靠问题明显,无法保证企业咨询服务质量;其次,政府、行政部门的政策保护、已有的资质认同感导致形成工程咨询行业壁垒,有政府背景的大型咨询企业也因政府的偏袒而忽略了市场的竞争性,这些问题充分说明我国现行的资质管理制度已不适合我国咨询行业发展的趋势,不利于工程咨询行业的健康良性竞争。因此,结合我国的基本国情以及工程咨询业的不可或缺性,对我国工程咨询业资质管理制度进行改革和创新是十分必要的。本论文按照理论与实际结合、创新性与可行性结合的基本原则,采取了规范研究与定量分析相结合的研究方式,具体内容如下:第一部分:本文通过查阅文献,现实调研等多种方式,详细阐述我国工程咨询业资质管理制度的基本概念、发展历程及等级标准,对比发达地区的工程咨询市场中资质管理制度的差异性,从中总结归纳出其优势,并探讨在我国咨询市场中的可行性。第二部分:在深入分析我国咨询行业资质管理制度的基础上,结合我国咨询业市场发展的特点,对暴露出的诸多资质管理制度问题进行剖析。第三部分:根据我国工程咨询业的现实需求,从市场方面,政府方面,咨询企业方面等进行创新研究,最后由工程咨询管理协会主导建立咨询企业服务质量评价体系,为取消资质管理制度的咨询市场,建立自由公平的资源优化配置的竞争体系,同时也有利于业主选择更符合自身咨询需求的工程咨询企业。第四部分:根据论文之前论述,总结我国工程咨询业应该完全取消资质管理机制的创新改革想法。在展望方面,对未来咨询市场的探索可以进一步从保持企业技术水平的先进性、增加优秀人才储备、谋求行业间合作共赢、建立信用评价体系等几个角度进行深入探讨,有利于工程咨询市场进一步的完善,实现市场对资源的优化配置。
