我国环境污染强制责任保险改革必要性及重点问题

【摘要】：2015年9月21日,中共中央、国务院印发了《生态文明体制改革总体方案》,其中明确提出"在环境高风险领域建立环境污染强制责任保险制度"。本文通过对我国环境污染强制责任保险的试点进展进行总结,探讨环境高风险企业界定、环境污染强制责任保险"强制"功能、生态环境损害纳入强制环责险的必要性与可行性等改革过程中需要解决的重点问题,对推动我国环境污染强制责任保险改革和发展提出建议。
[Abstract]:In September 21st 2015, the CPC Central Committee, The State Council issued and published the General Plan for the Reform of the Ecological Civilization system, which clearly puts forward the "Establishment of compulsory liability Insurance system for Environmental pollution in the Field of High risk of the Environment". This paper summarizes the progress of the pilot projects of compulsory liability insurance for environmental pollution in China. This paper discusses the key problems to be solved in the process of reform, such as the definition of enterprises with high risk of environment, the "compulsory" function of compulsory liability insurance for environmental pollution, the necessity and feasibility of bringing ecological environmental damage into compulsory environmental liability insurance, and so on. Some suggestions are put forward to promote the reform and development of compulsory liability insurance for environmental pollution in China.
