我国保险消费者权益保护机制探析

【摘要】:我国保险市场起步较晚,发展的水平较低,且保险合同具有高度的专业性,消费者的保险知识普遍较低,保险消费者权益侵害事件时有发生,这已经严重影响到保险业的声誉和生存,如何有效保护消费者利益成了决定保险业是否能继续健康发展的关键因素。为了改变保险消费者处于弱势地位的局面,很多国家的相关立法和监管都顺应了保险消费者权益保护的国际趋势。由于近几年我国保险投诉和保险纠纷案件的频频上升,我国更需要全面建立保险消费者权益保护机制。 本文在在借鉴国际国内学者现有研究成果上,主要通过理论梳理、现状研究、原因分析、国外经验比较借鉴等方式,重点研究了我国保险消费者权益受损的主要形式及诱因,分析了我国保险消费者权益保护机制存在的不足:在此基础上,借鉴国外的经验,从法律监管、内部控制、纠纷处理三大维度提出了我国保险消费者权益保护机制构建的政策思路。全文共包括五大部分,各章主要研究内容及观点简要概述如下: 第1章:导论。这部分在文献的梳理基础上,主要介绍了问题提出的背景、研究目的和意义,以及国内外对相关问题的研究现状。 第2章:介绍了我国保险消费者权益受损的主要形式及诱因分析。针对我国保险市场中反映出来的较严重问题,分析了保险消费者权益受损的主要方面及其原因。研究认为,保险消费者主要是在知情权、损害求偿权、公平交易权三方面的权益受到损害,而其中最突出的表现是销售误导、理赔难、保险费率偏高等。文章还分别分析了产生这些权益受损问题的诱因,以期为下文对问题做进一步的制度分析奠定基础。 第3章:我国保险消费者权益保护机制存在的不足。该章在概括分析我国政府监管部门和保险行业协会近年在保障消费者权益方面所作探索和实践基础上,重点探讨了我国保险消费者权益保护制度和机制存在的不足。研究认为,当前我国在保险消费者权益保护的法律法规建设、保险监管体系、保险纠纷防范机制与纠纷解决机制等四方面存在严重的制度层面不足。 第4章:国外保险消费者权益保护的经验研究。这章对美、英、日三大保险业发达国家的对我国有启发借鉴意义的保险消费者权益保护经验进行了分析。分析认为,发达国家在构建完善的保险法律体系、设立专门的保险消费者权益保护机构、建立保险消费者投诉处理机制和强化保险行业自律机制等方面为保险消费者织起了一层层安全保护网。 第5章:我国保险消费者权益保护机制的对策建议。论文结合目前我国保险市场的现状,借鉴国外经验,较系统地提出了我国保险消费者权益保护机制的构建思路:首先要完善法律法规保护机制,建立起一个良好的保护环境;第二层次是保险公司的信息披露与外部监管相结合的监督机制,在法律法规无法有效约束的情况下监督机制要发挥作用;第三层次是保险公司公司治理的改进,以形成法律与监管之外的市场制衡力量;第四层次是着眼于保险代理人的重要影响作用而设计的激励约束机制;最后是在纠纷发生的情况下,消费者自身可以选择的多元化纠纷解决机制。当然以上五个层面的机制并不是相互独立、各自运转的,它们需要相互协调合作才能发挥出保护保险消费者权益的最大合力。 文章的主要特色和创新之处在于:第一,本文以时下保险界最热点的话题车险理赔难、寿险销售误导为背景,围绕保险消费者权益保护这一主题,对保险消费者权益受损形式与诱因、我国保险消费者权益保护机制存在的不足等进行了较深入分析。结合国内相关部门所作的保护实践和国际经验,从五个层面提出了我国保险消费者权益保护机制的构建思路,形成了比较完整的保险消费者权益保护框架,这构成了本文最大的创新之处;第二,根据我国保险市场的实际情况,论文创新性地提出了让保险消费者参与保险公司治理,为保险消费者权益保护的后续研究开辟了一个新的方向。文章还存在许多不足之处,对问题的剖析不尽深入,自身的观点也存在片面性,特别是对于最后政策建议部分中保险公司内部治理改善缺乏具体的操作方法,同时,其可操作性也有待进一步论证,纠纷解决机制的设计缺乏具体措施。
[Abstract]:The insurance market in China is late, the level of development is low, and the insurance contract has a high degree of professionalism, the insurance knowledge of the consumer is generally low, the insurance consumer's rights and interests are infringed on. This has seriously affected the reputation and survival of the insurance industry. How to effectively protect the interests of the consumer has become a decision whether the insurance industry can continue. In order to change the situation of healthy development, in order to change the situation that the insurance consumers are in a disadvantaged position, the relevant legislation and supervision of many countries have conformed to the international trend of the protection of the rights and interests of the insurance consumers. Because of the frequent rise of the cases of insurance complaints and insurance disputes in China in recent years, our country needs to establish the protection of the protection of the rights and interests of the insurance consumers in an all-round way. Mechanism.
On the basis of the existing research achievements of international and domestic scholars, the main forms and causes of the damage of the rights and interests of the insurance consumers in China are mainly studied through the theoretical carding, the current situation research, the reason analysis and the foreign experience, and the deficiency of the protection mechanism of the insurance consumer in China is analyzed. On this basis, From the experience of foreign countries, from the three dimensions of legal supervision, internal control and dispute handling, we put forward the policy ideas for the construction of the protection mechanism of China's insurance consumers' rights and interests. The full text includes five parts, and the main contents and views of each chapter are briefly summarized as follows:
The first chapter: introduction. On the basis of combing the literature, this part mainly introduces the background of the question, the purpose and significance of the research, and the research status of the related issues at home and abroad.
The second chapter introduces the main forms and causes of the damage to the rights and interests of the insurance consumers in our country. In view of the serious problems reflected in the insurance market in China, the main aspects and reasons for the damage of the rights and interests of the insurance consumers are analyzed. The research holds that the insurance consumers are mainly in the right to know, the right to claim damages, and the three aspects of the fair trade right. The most prominent manifestation of the rights and interests is the misleading of sales, the difficult claim and the high premium rate. The article also analyzes the reasons for the damage of these rights and interests, in order to lay the foundation for the further institutional analysis of the following problems.
The third chapter: the deficiency of the protection mechanism of China's insurance consumer rights and interests. On the basis of summarizing and analyzing the exploration and practice of our government supervision department and the insurance industry association in the protection of the rights and interests of consumers in recent years, this chapter focuses on the shortcomings of the system and mechanism of the protection of the rights and interests of the insurance consumers in our country. There are four serious deficiencies in the system level in the construction of the laws and regulations of the protection of the rights and interests of the insurance consumers, the insurance supervision system, the prevention mechanism of the insurance dispute and the dispute settlement mechanism.
The fourth chapter: An Empirical Study on the protection of the rights and interests of foreign insurance consumers. This chapter analyses the experience of protecting the protection of the rights and interests of the insurance consumers in the three major developed countries of the United States, Britain and Japan. The analysis holds that the developed countries are building a perfect insurance legal system and setting up a special protection machine for the insurance consumer. The establishment of an insurance consumer complaint handling mechanism and strengthening of the insurance industry self-regulation mechanism has created a layer of safety protection network for insurance consumers.
The fifth chapter: the countermeasures and suggestions for the protection mechanism of the insurance consumers' rights and interests of our country. Combining with the present situation of the insurance market in China and drawing on the experience of foreign countries, the paper systematically puts forward the idea of establishing the protection mechanism of the rights and interests of the insurance consumers in our country. First, we should perfect the protection mechanism of laws and regulations, establish a good protection environment; the second level. It is the supervision mechanism that the insurance company combines information disclosure and external supervision. The supervision mechanism should play a role in the situation that the laws and regulations can not be effectively restrained; the third level is the improvement of the corporate governance of the insurance company to form the market balance outside the law and supervision, and the fourth level is an important shadow of the insurance agent. The incentive and constraint mechanism designed by the sound effect is the end of the diversified dispute resolution mechanism that consumers can choose under the circumstances of the dispute. Of course, the above five levels of the mechanism are not independent and operate each other. They need to coordinate and cooperate with each other in order to produce the greatest resultant force to protect the rights and interests of the insurance consumers.
The main features and innovations of this article are as follows: first, this paper, with the most hot topics in the insurance industry, is difficult to compensate for vehicle insurance, mislead the life insurance sales as the background, and focus on the protection of the rights and interests of the insurance consumers, and makes a comparison of the forms and causes of the damage to the rights and interests of the insurance consumers, and the deficiency of the protection mechanism of the insurance consumers in China. In depth analysis, combined with the protection practice and international experience made by the relevant domestic departments, the construction ideas of the protection mechanism for the rights and interests of the insurance consumers in China are put forward from five levels, and a more complete protection framework for the rights and interests of the insurance consumers has been formed, which constitutes the biggest innovation in this article; second, according to the actual situation of the insurance market in China. This paper innovatively proposes that the insurance consumers participate in the management of insurance companies, which has opened up a new direction for the follow-up study of the protection of the rights and interests of the insurance consumers. There are many shortcomings in this article, and the analysis of the problems is not thorough and its own views are one-sided, especially for the insurance companies in the final policy recommendations. The internal governance improvement lacks specific operation methods, and its operability needs further demonstration. The design of dispute settlement mechanism lacks specific measures.
