构建中国保险行业征信体系研究

【摘要】:诚信是一切市场交易行为的基础,在以市场化为核心的现代社会中,诚信越来越受到关注,与每一个人的日常生活密不可分。现代社会解决诚信问题的主要方式之一就是通过建立征信体系尽可能消除信息不对称现象,这也使得征信体系伴随着商品经济的发展逐渐成为人们社会生活的重要工具之一。然而以经营风险,销售承诺为特征的中国保险行业长期以来却没有必要的征信体系,随着从业人员规模和行业产值的不断增加,诚信问题已经成为制约保险行业长期、健康和可持续发展的重要因素,严重影响了整个行业的社会形象,阻碍了整个行业向精细化的发展转型。近年来,行业内外对于解决保险诚信问题,建立必要的征信体系的呼声日趋高涨,特别是在党的十八届四中全会将社会征信建设列入法制建国的重要组成部分之后,保险行业的诚信建设再次引起了各界的关注,可以说建立和规范保险行业征信制度已经刻不容缓。正是基于上述的背景,本文从理论与实践相结合的角度出发,研究和讨论了如何建立中国保险行业的征信体系。一个行业征信体系的建立是一个复杂的系统性工程,而国内外的成功经验为保险行业提供了众多有益的参考。通过对这些经验以及现存问题的研究和分析,我们可以发现尽管征信体系会因其所服务的对象,所处国家的政治、法律和社会背景而体现出一定的差异性,但是也有其特定的规律可循。首先是建立征信体系必须要有完善的法律制度环境;其二是完善的基础数据库是征信体系存在的基础,而要完善数据库则取决于信息的提供者和使用者;其三是征信体系要被置于严格的监管框架内;其四是征信信息要高度规范化。基于上述的这些结论,并结合保险行业的实际情况,本文对于国内保险行业征信体系的建设给出了具体的规划,即要采用综合型行业性会员制的发展模式,强调公共机构与市场化机构相结合,从业机构、人员信息和客户信息三者并重的思路。进一步,对于最基础的行业征信信息数据库的建设,也在经过市场初步实践的前提下给出了相应的方案,最后从审慎的角度出发对建立征信体系可能会面临的问题加以了分析并提出了初步的解决思路。
[Abstract]:Honesty is the basis of all market transactions. In the modern society with marketization as the core, honesty and credit are paid more and more attention, which is closely related to the daily life of everyone. One of the main ways to solve the problem of honesty and credit in modern society is to eliminate information asymmetry by establishing credit information system, which makes credit information system gradually become one of the important tools of people's social life with the development of commodity economy. However, China's insurance industry, characterized by business risks and sales commitments, has not had a necessary credit system for a long time. With the continuous increase in the number of employees and the output value of the industry, the issue of good faith has become a long-term constraint on the insurance industry. The important factors of healthy and sustainable development have seriously affected the social image of the whole industry and hindered the whole industry from transforming into fine development. In recent years, there has been a growing demand both inside and outside the industry for solving the problem of insurance honesty and establishing the necessary credit information system, especially after the fourth Plenary session of the 18th CPC Central Committee included social credit information construction as an important part of the founding of the legal system. The honesty construction of insurance industry has aroused the attention of all walks of life again. It can be said that it is urgent to establish and standardize the credit investigation system of insurance industry. Based on the above background, this paper studies and discusses how to establish the credit system of China's insurance industry from the angle of combining theory with practice. The establishment of an industry credit system is a complex systematic project, and the successful experience at home and abroad provides many useful references for the insurance industry. Through the research and analysis of these experiences and the existing problems, we can find that although the credit system can reflect some differences because of the target, the political, legal and social background of the country. But there are certain rules to follow. First of all, the establishment of credit system must have a sound legal system environment, the second is that the perfect basic database is the basis of the credit system, and to improve the database depends on the information provider and user. The third is that the credit information system should be placed in a strict regulatory framework, and the fourth is that the credit information should be highly standardized. Based on the above conclusions, and combined with the actual situation of insurance industry, this paper gives a specific plan for the construction of domestic insurance industry credit system, that is, to adopt the comprehensive industry membership system development model. It emphasizes the combination of public institutions and market-oriented institutions, and the thinking of equal emphasis on employment institutions, personnel information and customer information. Further, for the construction of the most basic industry credit information database, the corresponding scheme is also given under the premise of preliminary market practice. Finally, the paper analyzes the problems that may be faced in the establishment of credit system from a prudent point of view and puts forward a preliminary solution.
