基于利益相关者的我国旅行社责任保险统保示范产品的优化研究

【摘要】:旅行社责任保险统保示范产品是国家旅游局牵头推出的旅行社责任保险产品,是针对旅行社专门设计的,该产品的推出在很大程度上解决了原旅行社责任保险产品存在的问题,因此可以作为目前国内旅行社责任保险产品的代表。但是作为新生产品,该项目在市场运行时间仅仅3年,在实际操作中出现了诸多问题。目前亟需对这一示范产品进行优化,保持其生机与活力,以免在激烈的市场竞争下,不能很好地满足各相关方的利益,逐渐丧失其市场份额,最终导致这一项目的失败。因此作者基于利益相关者视角,来研究旅行社责任保险统保示范产品的优化,以求对我国旅行社责任保险统保示范产品的改进和完善提供一定的帮助。 本研究采用文献检索、问卷调查、深度访谈与案例比较等研究方法对我国旅行社责任保险统保示范产品的存在问题进行剖析,发现旅行社责任保险统保示范产品存在保费偏高、结案率不高、赔偿标准不明确、履行承诺不严格、部分地区存在强制购买现象等问题;基于利益相关者理论,结合典型案例,分别从各利益相关者视角,提出了我国旅行社责任保险统保示范产品的优化原则、优化内容及相关建议。 研究指出旅行社责任保险统保示范产品的优化,要坚持系统性原则、动态性原则、市场化原则和法制化原则;旅行社责任保险统保示范产品的优化要明确责任、细化保障范围;要从行业特点出发,设计灵活的费率机制;要提高运行机制效率、注重服务和考核;要实施快付机制,以提升形象和满意度。此外,旅行社责任保险统保示范产品的优化需要旅行社、保险经纪公司、共保体公司、调处中心、旅游主管部门等利益相关者共同努力来实现。 研究针对旅行社责任保险统保示范产品保费高、被强制投保等问题,认为待该统保示范产品运行模式成熟后,应对共保体公司和保险经纪公司逐步建立进入和退出机制。希望通过推动我国的旅游责任保险统保示范产品的优化与完善,,使产品在转移旅行社责任风险、保障旅游者合法权益,实现旅游业又好又快发展,促进政府部门职能转变,维护社会稳定等方面起到更有效的作用。
[Abstract]:The travel agency liability insurance model product is a travel agency liability insurance product led by the National Tourism Administration. It is specially designed for travel agencies. To a great extent, the introduction of this product solves the problems existing in the original travel agency liability insurance products. Therefore, it can be used as the representative of domestic travel agency liability insurance products. However, as a new product, the project has only run in the market for 3 years, and many problems have appeared in the actual operation. At present, it is urgent to optimize the demonstration product to keep its vigor and vitality so as not to satisfy the interests of all relevant parties and lose its market share gradually under the fierce market competition, and finally lead to the failure of this project. Therefore, based on the stakeholder perspective, the author studies the optimization of the model product of travel agency liability insurance, in order to provide some help to improve and perfect the demonstration product of travel agency liability insurance. In this study, we analyzed the existing problems of the model products of travel agency liability insurance by literature retrieval, questionnaire survey, in-depth interview and case comparison, and found that the insurance premium of travel agency liability insurance model product is on the high side. The case rate is not high, the standard of compensation is not clear, the implementation of commitments is not strict, there are some problems such as forced purchase in some areas; based on stakeholder theory, combined with typical cases, from the perspective of each stakeholder, This paper puts forward the optimization principle, optimization contents and relevant suggestions of the model product of travel agency liability insurance in China. The study points out that to optimize the model products of travel agency liability insurance, we should adhere to the systematic principle, the dynamic principle, the market-oriented principle and the legal principle, and the optimization of the model product of travel agency liability insurance should be clear about the responsibility and refine the scope of guarantee. It is necessary to design a flexible rate mechanism according to the characteristics of the industry, to improve the efficiency of the operation mechanism, to pay attention to service and assessment, and to implement the quick payment mechanism to enhance the image and satisfaction. In addition, the optimization of the model product of travel agency liability insurance needs the joint efforts of travel agency, insurance broker, co-insurance company, mediation center, tourism department and other stakeholders. In view of the problems of travel agency liability insurance, such as high premium and compulsory insurance, it is considered that when the operation mode of the model product is mature, the entry and exit mechanism should be established step by co-guarantee company and insurance broker company. It is hoped that by promoting the optimization and improvement of the demonstration products of tourism liability insurance in China, the products will transfer the risk of travel agency liability, protect the legitimate rights and interests of tourists, realize the sound and rapid development of tourism, and promote the transformation of the functions of government departments. Maintain social stability and other aspects play a more effective role.
