职工养老保险领域的待遇维权行为研究

【摘要】：近年来,在我国由传统的农业社会向现代化工业社会、由同质社会向异质社会、由伦理社会向法理社会、由计划经济向市场经济的转型过程中,社会结构发生了巨大的变化。在这一特殊背景下,利益分化与失衡代替普遍受益成为转型社会利益格局的主要特征。尤其是在企业间及企业内不同退休群体人员间的养老金水平一直比例悬殊,难以平衡。除此之外,还有部分灵活就业人员、农民工和未就业人员这些在城镇职工养老保险制度涵盖范围内的人群甚至并没有完全享受到经济高速发展下所带来的养老福利,由此引发的养老待遇维权成为各类维权事件中的焦点。全国各地频繁出现维权事件,已然变成社会稳定发展突出矛盾之一。我国社会发展进入一个关键时期,既是经济迅速发展的关键时期,又是各种不协调因素活跃和社会矛盾多发时期,进入社会结构深刻变动、社会矛盾易激化的高风险期。事实上,一系列的养老待遇维权事件都是社会改革时期我国各种社会问题的集中体现。本文首先以职工养老保险的覆盖人群作为调查对象。维权者由于制度因素和非制度因素共同作用下致使养老待遇维权事件频繁发生。本文首先从微观层面上梳理养老保险制度整合进程中的养老待遇维权的典型个案。归纳发现维权者主要围绕养老待遇不公、身份不明、缴费基数、工龄计算、缴费年限、退休年龄、养老金计发等七个方面展开诉求。主要通过法律维权、行政上访、非法维权和新兴维权行为四种方式来表达自己的利益诉求。接着通过定量分析得出部分个体特征变量对养老维权手段的选择具有影响,而且受访者对社会风险的主观评估、制度设计缺陷的主观评估、养老保险公信力的主观评估以及维权意识和资源四个因素均对维权手段的选择均有不同程度的影响。
[Abstract]:In recent years, in the process of transformation from traditional agricultural society to modern industrial society, from homogeneous society to heterogeneous society, from ethical society to legal society and from planned economy to market economy, the social structure has undergone tremendous changes. In this special background, interest differentiation and imbalance instead of universal benefit become the main characteristics of social interest pattern. Especially among enterprises and among different retirement groups, pension level has always been uneven and difficult to balance. In addition, some flexible workers, migrant workers and underemployed people who are covered by the urban workers' pension insurance system have not even fully enjoyed the pension benefits brought about by the rapid economic development. Therefore, the rights of the old-age treatment become the focus of all kinds of rights-safeguarding events. The frequent occurrence of rights-safeguarding incidents throughout the country has become one of the outstanding contradictions in social stability and development. China's social development has entered a critical period, which is not only a critical period of rapid economic development, but also a period of active disharmony factors and frequent social contradictions. It has entered a period of high risk of profound changes in social structure and aggravation of social contradictions. In fact, a series of pension rights protection events are the concentrated embodiment of various social problems in China during the period of social reform. This article first takes the employee endowment insurance coverage crowd as the investigation object. Because of the system factor and non-system factor, the rights-defending event of the old-age treatment occurs frequently. This paper firstly combs the typical cases of old-age protection rights in the process of the integration of pension insurance system from the micro level. It is found that defenders mainly focus on seven aspects, such as unfair pension treatment, unidentified identity, payment base, working age calculation, contributory years, retirement age, pension plan and so on. Mainly through legal rights, administrative petition, illegal rights protection and emerging rights protection behavior to express their interests. Then through quantitative analysis, it is concluded that some individual characteristic variables have an impact on the choice of means to safeguard the rights of the aged, and the subjective assessment of the social risk and the defects of the system design of the interviewees. The subjective evaluation of the public trust of endowment insurance, the awareness of safeguarding rights and the four factors of resources have different effects on the choice of means of safeguarding rights.
