美国政府食品安全监管制度对我国的启示

【摘要】:“民以食为天”是中国五千年来留下来的文化传统,食品安全问题是与公民的健康息息相关的。近些年来,我国在食品安全问题上频频爆发危机,给人民的生命以及财产带来了巨大的损失。与此同时,国家乃至各级政府的监管部门的行政职能以及监管执法的信用也被屡次亮起了红灯,导致了政府的公信力下降。作为时代接班人的我们将来要担负起社会的责任,无论是扮演政府监管部门的角色还是担当企业生产者的角色,都要对是食品安全问题有一个深层次的认识,努力改善当前的市场状况,不断完善和提高国家食品安全监管制度。 本文从实际角度出发,通过针对现今市场数据的调查同美国食品安全制度上的成功经验进行比较分析来研究在我国食品安全行政监管制度上所存在的问题,并经过深思与探讨,找寻对策并提出合理的建议。正文共分三大部分,第一部分为中美食品监管制度的比较,通过对法律,职能部门和生产过程中的政府作为等方面较得出我国同美国食品监管制度方面的差异;第二部分是对我国在现阶段政府食品安全监管的状况及问题分析,举例说明了当前我国在食品安全上出现问题的原因以及政府现阶段在处理食品安全问题时所面临的困境,剖析了当前我国在食品安全问题上所面临的根本问题。第三部分为美国食品安全监管制度对我国政府的启示,以美国行政部门对食品安全做法的先进点为参考,找出当前我国食品安全立法、执法的薄弱点以及政府职能部门在监管过程中存在的问题,提出应如何建立食品安全预警机制的方法以及具体实施的对策,从而改变我国食品安全问题的现状,合理优化行政资源配置,完善提高整个食品安全监管制度。
[Abstract]:"Food as the sky" is a cultural tradition left over by China for five thousand years. Food safety is closely related to the health of citizens. In recent years, our country frequently breaks out the crisis on the food safety problem, has brought the huge loss to the people's life and the property. At the same time, the administrative functions and the credit of supervision and enforcement of the state and all levels of government have been repeatedly red flags, resulting in a decline in the credibility of the government. As successors of the times, we will have to shoulder the responsibility of the society in the future. Whether we are playing the role of the government supervision department or the role of the enterprise producer, we must have a deep understanding of the food safety problem. Strive to improve the current market situation, constantly improve and improve the national food safety regulatory system. From a practical point of view, this paper studies the problems existing in China's food safety administrative supervision system through the comparative analysis of the current market data survey and the successful experience of the food safety system in the United States. Look for countermeasures and put forward reasonable suggestions. The text is divided into three parts. The first part is the comparison of the food regulatory system between China and the United States. The differences between China and the United States in the food regulatory system are obtained through the comparison of the laws, functional departments and government actions in the production process. The second part is an analysis of the current situation and problems of government food safety supervision in China, with examples to illustrate the causes of the problems in food safety and the difficulties the government is facing in dealing with food safety problems at the present stage. The basic problems of food safety in our country are analyzed. The third part is the enlightenment of the American food safety supervision system to our government, taking the advanced point of the food safety practice of the American administrative department as the reference, to find out the current food safety legislation of our country. The weakness of law enforcement and the problems existing in the process of supervision and control of the government functional departments are put forward. The methods of how to establish the food safety warning mechanism and the concrete implementation countermeasures are put forward, so as to change the current situation of food safety problems in our country. Optimize the allocation of administrative resources and improve the whole food safety supervision system.
