基于风险分析的承包商索赔管理研究

【摘要】：目前，我国建筑市场竞争日益激烈，承包商为了赢取项目常常采取低价中标的策略，其利润水平也越来越低，处于相对被动地位的承包商正努力提高自身项目管理水平，争取通过其他方式弥补由于低价中标造成的利润减少。索赔管理因其成本较低、经济效果明显而受到承包商的青睐，并且已成为承包商在工程项目全过程中保护自身合法权益、弥补工程损失、提高经济效益的重要策略。我国的索赔管理起步较晚，虽然近几年国内的索赔管理研究有了较大的进展，但相关理论研究和实践应用尚处于不完善阶段，尤其是对于在工程项目中处于被动地位的承包商，如何进行合理的工程风险分析，并建立基于风险的索赔管理机制，已成为当前建筑企业各方，尤其是承包商亟待解决的问题，，这也正是本文研究的目的。本文站在承包商的角度，首先对国内外有关风险分析及索赔管理的理论进行了系统介绍，论述了索赔风险的含义、风险分析的方法与程序，以及我国承包商索赔管理的现状，在此基础上进行承包商风险识别，对各种风险源和风险事件进行分类，构建承包商索赔风险清单。然后，采用模糊数学的方法，构建基于风险分析的承包商索赔风险评价模型，并结合青岛市某高层小区的实例，对其索赔风险进行了量化分析和排序。最后，针对索赔因素的风险大小提出了五项索赔管理策略，以为索赔管理提供新的思路。
[Abstract]:At present, the competition in China's construction market is increasingly fierce, contractors often adopt the strategy of winning bids at low prices in order to win projects, and their profit levels are getting lower and lower. Contractors in a relatively passive position are trying to improve their project management level. Try to make up for the decrease in profits by winning a bid at a low price in other ways. Claim management has been favored by contractors because of its low cost and obvious economic effect. It has become an important strategy for contractors to protect their legitimate rights and interests, make up for project losses and improve economic benefits in the whole process of construction projects. The claim management in China started relatively late. Although the research on claim management in China has made great progress in recent years, the relevant theoretical research and practical application are still at an imperfect stage, especially for contractors who are in a passive position in engineering projects. How to carry out reasonable engineering risk analysis and establish a risk-based claim management mechanism has become an urgent problem for all parties in construction enterprises, especially contractors, which is the purpose of this paper. From the point of view of contractor, this paper introduces systematically the theories of risk analysis and claim management at home and abroad, and discusses the meaning of claim risk, the methods and procedures of risk analysis, and the present situation of claim management of contractors in China. On this basis, contractor risk identification is carried out, risk sources and events are classified, and contractor claim risk list is constructed. Then, the risk evaluation model of contractor's claim based on risk analysis is constructed by using fuzzy mathematics, and the claim risk of a high-rise residential district in Qingdao is analyzed quantitatively and ranked according to the example of a high-rise residential district in Qingdao. Finally, according to the risk of claim factors, five claims management strategies are put forward to provide new ideas for claim management.
