巴黎德鲁奥拍卖行研究

【摘要】:中国拍卖行业,尤其是艺术品交易市场,近二、三十年发展迅速,成为世界上最重要的拍卖市场之一。然而,业界普遍存在的赝品充斥、"假拍"、"拍假"等行业乱象,极大地损伤行业信誉,引起了社会各界的普遍关注。中国拍卖业虽然取得了举世瞩目的成绩,与欧美发达国家相比,国内拍卖基础理论的研究、法律法规的健全、行业规范的完善、从业人员素质的提高等等,都还有着很大的提升空间。当今世界上,英国和美国的拍卖行业最具有竞争力,每年拍卖成交总额和总成交件数都遥遥领先。法国在18世纪之后,曾长期作为世界的文化中心。在首都巴黎,大量的艺术运动和文化思潮此起彼伏,涌现出像伏尔泰、卢梭、福楼拜、雨果、笛卡尔等众多哲学、文学和科学等各类学科的先驱人物,吸引如毕加索、居里夫人等欧洲其他国家的优秀人物聚集。法语文化在全欧洲风行,18世纪末的俄罗斯宫廷,甚至都以其为官方语言。艺术品市场也尤其发达,在首都巴黎,尤其聚集了大量的艺术品交易商、画廊、艺术赞助人、收藏家和一流的艺术创作者。如今,虽然行业整体大不如前,在市场体量上不及英美,但在年总成交件数上表现依然亮眼。法国拍场的平民化、对拍品的保真承诺等等,都彰显出法国拍卖市场独特之处。在努力学习西方,改革市场经济体制、发展中国现代拍卖行业的路途上,法国拍卖行业的经验同样是值得学习借鉴的。巴黎德鲁奥拍卖行建成开放于1852年,其前身更可追溯至1800年前后,在超过一个半世纪的时间里,德鲁奥拍卖行经历了无数的挑战。巴黎公社、两次世界大战、经济萧条时期以及被欧盟强制要求开放市场竞争等等,德鲁奥拍卖行都成功地渡过难关。历史发展悠久,底蕴深厚,德鲁奥拍卖行堪称法国最古老的拍卖行,也是法国拍卖业界的代表。本文即从历史传统、法制、业务操作和数据分析这四个方面对巴黎德鲁奥拍卖行进行个案研究,探索法国拍卖行业的特点和趋势。在每一章的小节中,会对比中国拍卖行业相应问题,并提出中国拍卖行业发展的思路和对策。本文不是一篇严格意义上的文化比较型论文,虽然第二章有中法不同文化传统对拍卖行业影响的论述,但本文侧重于巴黎德鲁奥拍卖行的个案研究,对于中国拍卖行业发展历史、现状和建议的部分并不是主要内容。对于国外拍卖行业的研究,特别是对法国拍卖行业的研究,目前学界发表的论文还很少,而对单个拍卖公司或者拍卖行的个案研究,更是微乎其微。本文作者虽然没有获得过法律、金融方面的学位,在法律论述、金融工具运用方面十分粗浅,但在相关领域还没有发表过任何个案研究论文的情况下,本文可抛砖引玉,为后来拍卖行业的学术研究作一参考。
[Abstract]:The auction industry in China, especially the art market, has developed rapidly in the past 20 to 30 years and has become one of the most important auction markets in the world. However, there are widespread fakes in the industry, such as "fake auction", "fake auction" and so on. It has greatly damaged the credibility of the industry and aroused widespread concern from all walks of life. Although the Chinese auction industry has made remarkable achievements, compared with the developed countries in Europe and the United States, the study of the basic theory of domestic auction, the sound of laws and regulations, There is still a lot of room for improvement with the perfection of industry norms and the improvement of the quality of employees. In today's world, the auction industry in the United Kingdom and the United States is the most competitive. France, after 18th century, has long been the cultural center of the world. In the capital, Paris, art movements and cultural trends have sprung up, such as Voltaire and Rousseau. Flaubert, Hugo, Descartes and many other pioneers in various disciplines of philosophy, literature and science attracted people such as Picasso. Good people from other European countries such as Madame Curie gathered. French culture became popular throughout Europe and even the Russian court in the late 18th century used it as the official language. The art market was especially developed, in the capital, Paris. In particular, there are a large number of art dealers, galleries, art patrons, collectors and first-rate art creators. Today, although the industry as a whole is not as big as before, it is not as large as Britain and the United States in terms of market size. However, the performance of the total number of transactions in the year is still bright. The popularization of the French auction field, the promise of fidelity to the lot, and so on, all show the uniqueness of the French auction market. They are trying to learn from the West and reform the market economic system. On the way to modern auction in China, the experience of the French auction industry is also worth learning. The Paris de Ruo auction house opened in 1852, and its predecessor dates back to 1800, for more than a century and a half. The Druo auction house has experienced numerous challenges. The Paris Commune, the two World Wars, the Depression and the open market competition forced by the European Union have successfully weathered the difficulties. The Druo auction house is the oldest auction house in France and a representative of the French auction industry. This paper makes a case study of the Paris Druo auction house from four aspects: historical tradition, legal system, business operation and data analysis. This paper explores the characteristics and trends of the auction industry in France. In the section of each chapter, the corresponding problems of the auction industry in China are discussed, and the ideas and countermeasures for the development of the auction industry in China are put forward. This paper is not a cultural comparative paper in the strict sense. Although the second chapter discusses the influence of different cultures and traditions of China and France on the auction industry, this paper focuses on the case study of Druo auction house in Paris, and on the history of the development of the auction industry in China. The current situation and suggestions are not the main contents. For the research of the foreign auction industry, especially the French auction industry, there are few papers published by academic circles at present, but the case studies on individual auction companies or auction houses. Although the author has not received a degree in law, finance, or the use of financial instruments, he has not published any case studies in related fields. This article can offer a reference for the academic research of auction industry.
