泉州市区流动商贩管理问题与对策分析

【摘要】：受到我国城市发展水平、社会就业等多种因素的影响,城市流动商贩问题一直是我国各大城市在进行城市管理过程中所面临的主要问题这一。城市流动商贩的管理一方面涉及到城市市容市貌、公共安全、卫生与社会秩序等问题,另一方面也涉及到民生与活跃市场经济的问题。如何科学把握城市流动商贩的“禁与放”问题,成为城市化进程中必须考虑的内容。本文以泉州市市区流动商贩的管理问题为研究对象,首先对国内外在流动商贩管理上的研究现状进行总结概述,提炼出有益于本文研究的相关成果。同时,对本文研究中所需要使用到的理论进行阐述说明,以为下文的分析提供理论准备。文章在分析泉州市区流动商贩的管理现状的基础上,对泉州市区流动商贩管理主体、管理模式进行了分析,认为通过市、区以及街道等各级政府有关部门的整治管理后,泉州市区流动商贩的随意占道经营行为有了较大改善,造成的各类民事纠纷与刑事案件数量均明显下降,群众的满意对也有所提升。但目前泉州市区流动商贩管理仍然存在你抓我躲,你走我摆的“猫鼠”困境,暴力抗法与暴力执法时有发生,运动式执法治标不治本,社会舆论同情弱势群体也让城市管理者在管理流动商贩时处于舆论被动。造成泉州市区流动商贩管理问题产生的原因在于包括主体因素、客体因素、环境因素。针对上述问题,本文在总结国内外的城市流动商贩管理经验的基础上,认为促进泉州市市区流动商贩管理水平的提升,可以从:转变流动商贩管理理念,完善泉州市流动商贩管理的法律体系,加强对流动商贩集聚区的视频监控,强化公共服务引导组建自律组织等方面进行改进。
[Abstract]:Influenced by many factors, such as the level of urban development, social employment and so on, the problem of mobile traders in cities is always the main problem in the process of urban management. On the one hand, the management of urban mobile vendors involves the city appearance, public safety, public health and social order, on the other hand, it also involves the livelihood of the people and the active market economy. How to scientifically grasp the problem of "prohibition and release" of urban mobile traders has become the content that must be considered in the process of urbanization. In this paper, the management of mobile vendors in Quanzhou City as the research object, first of all, at home and abroad in the management of mobile vendors summarized the status quo, extract the relevant results beneficial to this study. At the same time, the theory needed in this study is explained to provide theoretical preparation for the following analysis. Based on the analysis of the current situation of the management of mobile vendors in Quanzhou urban area, this paper analyzes the main body and mode of management of mobile vendors in Quanzhou urban area, and thinks that through the regulation and management of the relevant government departments at all levels, such as city, district and street, etc., The haphazard business behavior of mobile traders in Quanzhou city has been greatly improved, resulting in a significant decline in the number of civil disputes and criminal cases, and the satisfaction of the masses has also been improved. However, at present, there are still mobile vendors in Quanzhou urban area. You take me to hide, you walk through my "cat and mouse" dilemma, violence against the law and violent law enforcement occur from time to time, and sports law enforcement does not cure the symptoms at all. Public opinion sympathizes with the weak groups and makes city managers passive in managing mobile vendors. The causes of the management problems of floating traders in Quanzhou city include subject factor, object factor and environment factor. In view of the above problems, based on the summary of the management experience of mobile vendors at home and abroad, this paper thinks that to promote the management level of mobile vendors in Quanzhou City, we can change the management concept of mobile vendors. Improve the legal system of mobile vendors management in Quanzhou, strengthen the video surveillance of mobile vendors gathering area, strengthen the public service to guide the establishment of self-discipline organizations and so on.
