【摘要】：为顺应经济全球化和区域经济一体化的潮流,中韩两国于2015年6月1日签署了《中华人民共和国政府和大韩民国政府自由贸易协定》,正式建立了东北亚地区第一个自由贸易区,促进东北亚区域经济一体化,也促进产业链的全面融合。它的签署对中韩两国乃至东北亚的经济都起到了巨大的推动作用。近年来,对于相关服务贸易规则的研究层出不穷,本文主要研究中韩自由贸易协定中的服务贸易规则。本文共分成三大部分。第一部分是对国际服务贸易规则的简要梳理。主要分成三大方面,第一方面是多边服务贸易规则,主要介绍了《服务贸易总协定》和《国际服务贸易协定》,前者是现行的多边服务贸易规则,而后者正在谈判进行中,中国也申请加入其谈判。第二方面是区域服务贸易规则,该部分主要从数量、分布以及签订的原因三个方面入手,分析区域服务贸易规则的现状。第三方面是中国缔结的国际服务贸易规则的概况。第二部分是本文的重点部分,是对中韩FTA服务贸易规则的分析。研究分析中韩FTA服务贸易规则,并将中韩FTA服务贸易规则与GATS、NAFTA中的服务贸易规则和CETA中的服务贸易规则进行比较分析,比较分析主要从适用范围、市场准入规则、国民待遇规则和原产地规则共四个方面入手,分析出其规则的差别导致的对于服务市场开放程度的差别及其反应出的问题。第三部分是对中韩FTA服务贸易规则的评价。这一部分主要对市场准入、国民待遇及原产地规则这三个方面进行评价。
[Abstract]:In order to comply with the trend of economic globalization and regional economic integration, China and South Korea signed the Free Trade Agreement between the Government of the people's Republic of China and the Government of the Republic of Korea on June 1, 2015, formally establishing the first Free Trade area in Northeast Asia. To promote regional economic integration in Northeast Asia, but also to promote the full integration of the industrial chain. Its signing has played a huge role in promoting the economy of China and South Korea, as well as Northeast Asia. In recent years, there are many researches on the rules of trade in services. This paper mainly studies the rules of trade in services in the free trade agreement between China and Korea. This paper is divided into three parts. The first part is a brief review of the rules of international trade in services. The first is the rules of multilateral trade in services, which mainly introduces the General Agreement on Trade in Services (GATS) and the Agreement on International Trade in Services, which is the current multilateral service trade rule, while the latter is under negotiation. China has also applied to join its negotiations. The second part is the rules of regional trade in services. This part analyzes the current situation of the rules of regional service trade from the aspects of quantity, distribution and reasons of signing. The third aspect is the general situation of the rules of international trade in services concluded by China. The second part is the key part of this paper, which is the analysis of China-Korea FTA service trade rules. The service trade rules of China-Korea FTA are analyzed, and the service trade rules in GATS NAFTA and CETA are compared and analyzed. The comparative analysis is mainly from the scope of application and the rules of market access. Starting with four aspects of the rules of national treatment and rules of origin, this paper analyzes the differences in the degree of openness to the service market caused by the differences in the rules and the problems reflected in them. The third part is the evaluation of China-Korea FTA service trade rules. This part mainly evaluates the three aspects of market access, national treatment and rules of origin.
