银行理财、信息披露与消费者知情权

【摘要】:日益增多的银行理财纠纷案件,凸显理财市场中消费者知情权常常受到侵犯,主要表现为宣传误导、说明不到位、客户风险评估走过场以及未进行后续信息披露。消费者与银行的交易地位不平等以及"经济人"的逐利性是其主要原因,立法缺失、监管不到位、司法保护不周也是其重要因素。借鉴发达国家规制银行理财市场的成功经验,应当从改变监管理念、变革监管模式、加强制度建设、完善纠纷解决机制等方面加强银行理财消费者知情权的法律保护。
[Abstract]:The increasing number of bank financial disputes highlights that the consumer's right to know is often violated in the financial management market, mainly for misleading propaganda, inadequate explanation, customer risk assessment and failure to disclose subsequent information. The main reasons are the unequal trading status between consumers and banks and the profit driven by "economic man". The lack of legislation, inadequate supervision and inadequate judicial protection are also important factors. To learn from the successful experiences of the developed countries in regulating the banking financial management market, we should strengthen the legal protection of the right to know of the consumers of banking financial management from the aspects of changing the supervision idea, changing the supervision mode, strengthening the system construction, perfecting the dispute resolution mechanism, etc.
