新型城镇化背景下土地改革方向探讨

【摘要】:土地改革的方向关系着我国工业化、城镇化能否顺利完成。而近期的土地改革政策和主张赋予农民土地完全的产权、允许农民自由买卖土地、所有权高于用途与规划管制的"土地绝对私有化"观点,并不能满足新型城镇化对土地改革的要求,并会造成一系列问题。在现行土地制度下,征地拆迁冲突的根本原因并不在于现行土地制度及其衍生的征地拆迁制度本身,而在于配套制度不完善、约束与管理不到位、征地拆迁没有法治化。新型城镇化背景下,土地改革的方向,应是在坚持现行土地制度框架的前提下,基于"涨价归公、地利共享"的目标取向,对其进行技术层面的修补。随着国家工业化、城镇化的推进和完成,土地制度的最终方向是实行城乡土地所有权的单一国有化和使用权的私有化,在符合用途和规划管制的前提下,实现城乡土地使用权的自由流转。
[Abstract]:The direction of land reform is related to industrialization and urbanization. Recent land reform policies and claims give farmers full property rights to land, allowing farmers to buy and sell land freely, and the idea of "absolute privatization of land" over use and planning control. Not to meet the new urbanization of land reform requirements, and will cause a series of problems. Under the current land system, the root cause of the conflict of land expropriation and removal is not the current land system and its derived system of land acquisition and removal, but the imperfect supporting system, the lack of restraint and management, and the lack of legalization of land requisition and removal. Under the background of new urbanization, the direction of land reform should be based on the goal of "increasing the price to the public, sharing the geographical position", on the premise of persisting in the existing land system framework, and carrying on the technical mending to it. With the development and completion of national industrialization and urbanization, the ultimate direction of land system is to implement the single nationalization of urban and rural land ownership and privatization of the right to use land, in accordance with the premise of use and planning control. Realize the free circulation of urban and rural land use right.
