【摘要】:随着我国经济与社会的不断发展,人民生活水平也大幅提高,消费者的观念逐渐由“吃得饱”向“吃得好”转变,对食品安全监管提出了更高的要求,这就需要我们的食品安全监管部门尽职尽责。而现实中食品安全往往出现监管漏洞,相关行政部门的监管不作为导致的重大食品安全事故的发生,给国家、集体和个人带来程度或大或小的损失。在我国目前的市场经济条件下,市场有其自主性,调节市场秩序是其固有功能,但在关乎国民身心健康的食品安全领域还需要国家的干预和调控,以此保障食品安全。因此笔者基于我国近年来食品安全监管不作为现状,对相关问题进行探究,不断完善我国的食品安全监管不作为。 本文分为五个部分对我国食品安全监管不作为问题进行阐述和探讨: 第一部分:对我国食品安全监管不作为的概述。这一部分主要从食品安全监管不作为的概念、特征、分类以及表现形式对其进行详细表述,使我们对研究对象有明确的认识。 第二部分:完善我国食品安全监管不作为的必要性。这一部分主要立足我国食品安全监管现实,通过真实案例,掌握我国食品安全监管现状,结合我国食品安全监管政府动态,介绍完善我国食品安全监管不作为的必要性。 第三部分:国外食品安全监管模式比较借鉴。这一部分主要介绍美国、日本和欧盟三个不同地域不同制度的国家在食品安全监管方面的做法,以期借鉴学习适合我国的好的制度。 第四部分:对我国食品安全监管不作为问题进行原因分析。这一部分主要从立法、司法、行政、社会、执法等方面对食品安全监管不作为深入揭示其理由。 第五部分:规制我国食品安全监管不作为的对策和思考。这一部分主要针对通过上述分析得出的我国食品安全监管不作为的原因进行对症思考,分别从相应的角度展开研究,提出有效对策。
[Abstract]:With the continuous development of our economy and society, the living standards of the people have also been greatly improved, and the concept of consumers has gradually changed from "eat well" to "eat well" and put forward higher requirements for the supervision of food safety. This requires due diligence on the part of our food safety regulators. However, in reality, there is often a regulatory loophole in food safety, and the occurrence of major food safety accidents caused by the omission of supervision by relevant administrative departments brings great or small losses to countries, collectives and individuals. Under the present condition of market economy in our country, the market has its own autonomy, regulating the market order is its inherent function, but in the field of food safety, which is related to the national health and physical health, it is necessary for the state to intervene and regulate in order to ensure the food safety. Therefore, based on the current situation of food safety supervision omission in China in recent years, this paper probes into the related problems and constantly improves the food safety supervision omission in China. This paper is divided into five parts to elaborate and discuss the problem of food safety supervision omission in China. Part one: an overview of the omission of food safety supervision in China. This part mainly describes the concept, characteristics, classification and manifestation of the omission of food safety supervision in detail, which makes us have a clear understanding of the object of study. The second part: the necessity of perfecting food safety supervision in China. This part is mainly based on the reality of food safety supervision in China, through real cases, grasp the current situation of food safety supervision in China, combined with the government dynamics of food safety supervision, introduce the necessity of perfecting the inaction of food safety supervision in China. The third part: the foreign food safety supervision mode comparison uses for reference. This part mainly introduces the practice of food safety supervision in three countries with different regions and different systems in the United States, Japan and the European Union, in order to learn from the good system suitable for our country. The fourth part: the reason analysis of the problem of food safety supervision omission in our country. This part mainly reveals the reasons for the omission of food safety supervision from the aspects of legislation, judicature, administration, society, law enforcement and so on. The fifth part: the countermeasures and thinking of regulating the omission of food safety supervision in China. This part mainly aims at the reason that our country food safety supervision does not act through the above analysis carries on the symptomatic thinking, separately carries out the research from the corresponding angle, puts forward the effective countermeasure.
