【摘要】:社会经济文化的不断进步发展,促进了社会管理模式的变革,改革开放30多年来,作为我国主要市场经济主体之一的企业得到了长足发展,在社会主义市场经济中占了举足轻重的地位。探索如何有效监管企业的方法,一直是众多学者的重点研究领域,而随着电子信息技术的不断完善,在西方国家已被运用近百年的社会信用监管体系模式进入视野,各行政管理部门也开展了一系列实践。 本文从信用及信用监管的相关概念和理论出发,分信用、企业信用体系、工商信用监管等不同角度,研究了国内外的研究现状及信用监管体系的相关理论、基本模式及操作方法,并结合工商行政管理的职能定位及基本情况,分析在企业信用监管体系建设中工商行政管理部门能发挥的作用。在此基础上,对浙江工商行政管理部门当前企业信用监管体系建设的具体实践进行全方位的研究,重点分析企业信用信息征集体系、信用评价体系及用信体系三个子体系的基本运营机制,运用博弈分析、成本效益分析等方法研究整个监管体系存在的不足和原因,并对上述分析的问题原因,分别从法律法规建设、征信评信用信系统优化及干部队伍素质提升等方面,提出有针对性的解决思路和办法。 通过研究发现,企业信用监管体系是针对企业等市场主体管理的一套行之有效的体系,西方发达国家已经建立相对完善的监管体系。浙江省的企业信用监管体系主要由工商行政管理部门牵头建设,但因缺乏有效的社会整合,仍旧存在征信体系不全面,数据不完整,评信体系中指标体系待整合验证,用信体系中对守信失信企业的奖励和惩戒覆盖面不够广等问题。要解决上述存在的问题不是一朝一夕的,但是也有迹可循,首先要从大的法律框架上下功夫,给予信用监管、信用监管体系建设以法律法规支持。其次针对现有监管体系中存在的问题,整合各机关部门及大型互联网企业的力量,扩大征信范围,科学论证评价指标体系,并推广用信体系的适用范围,切实做到有奖有罚且落到实处。最后要从完善监管队伍体系的角度,增强人员的责任心和使命感,不断开展业务和理论知识方面的培训,并通过岗位练兵、轮岗换岗等方式,调动监管人员的积极性,强化实践能力。
[Abstract]:The continuous development of social economy and culture has promoted the transformation of social management mode. Since the reform and opening up, the enterprises, as one of the main market economy subjects in China, have made great progress in the past 30 years. In the socialist market economy has played a pivotal role. Exploring the method of how to supervise enterprises effectively has been the key research field of many scholars. With the continuous improvement of electronic information technology, the model of social credit supervision system has been used in western countries for nearly a hundred years. Various administrative departments have also carried out a series of practices. Based on the related concepts and theories of credit and credit supervision, this paper studies the current situation of domestic and foreign research and the relevant theories of credit supervision system from different angles such as credit, enterprise credit system, business credit supervision, etc. The basic mode and operation method, combined with the function orientation and basic situation of industrial and commercial administration, this paper analyzes the role that the administrative department of industry and commerce can play in the construction of enterprise credit supervision system. On this basis, this paper makes a comprehensive study on the concrete practice of the construction of the current enterprise credit supervision system in Zhejiang Industry and Commerce Administration, and focuses on the analysis of the enterprise credit information collection system. The basic operation mechanism of the credit evaluation system and the three sub-systems of the credit evaluation system and the credit system are studied by the methods of game analysis, cost-benefit analysis and so on, and the reasons for the problems in the above analysis are analyzed. From the aspects of the construction of laws and regulations, the optimization of credit rating credit system and the improvement of the quality of cadres, this paper puts forward some solutions. Through the research, it is found that the enterprise credit supervision system is an effective system for the management of enterprises and other market subjects, and the western developed countries have established a relatively perfect regulatory system. The enterprise credit supervision system in Zhejiang Province is mainly built by the administrative department of industry and commerce. However, due to the lack of effective social integration, there still exists incomplete credit information system and incomplete data, and the index system in the credit evaluation system needs to be integrated and verified. In the credit system, the reward and punishment coverage of the trustworthy enterprises is not wide enough. In order to solve the above problems, it is not overnight, but there are also signs to follow, first of all, from the large legal framework, to give credit supervision, credit supervision system construction with laws and regulations to support. Secondly, aiming at the problems existing in the existing regulatory system, integrating the strength of various departments and large Internet enterprises, expanding the scope of credit information, scientifically demonstrating and evaluating the index system, and popularizing the scope of application of the credit system, Be sure to reward and punish and put it into practice. Finally, from the point of view of perfecting the supervisory team system, we should enhance the personnel's sense of responsibility and mission, continue to carry out training in business and theoretical knowledge, and mobilize the enthusiasm of the supervisors by means of post training and job turnover. Strengthen the practical ability.
