工商行政管理部门网络商品交易监管的问题研究

【摘要】：网络经济的飞速发展,为国家经济发展带来了新的活力,但是由于网络市场的开放性和虚拟性,使得政府监管出现了很多的问题,例如虚假宣传,欺诈消费者,不正当经营等行为,都是网络经济飞速发展的附属品,并且由于我国网络商品交易的监管起步较晚,基础比较薄弱,而网络商品交易中存在的问题又很多,网络商品交易的监管还有很多不足,比较混乱,监管职责不清,调查取证困难等问题日益凸显,在一定程度上阻碍了网络商品交易市场的发展,是消费者的合法权益无法得到保障,影响了国民经济的发展和构建和谐社会。 本文作者作为一名在工商行政执法第一线的执法人员,着重以工商部门的视角,通过分析工商行政管理部门网络商品交易监管的具体做法,在借鉴国外先进经验和做法的同时,结合具体监管情况,找出我国网络商品交易监管中存在的问题,并提出完善立法、建立网络商品交易市场准入登记系统和网上监管系统、加强培训等措施对网络商品交易监管中存在的问题予以解决,具有一定的可行性和现实意义。
[Abstract]:The rapid development of the network economy has brought new vitality to the national economic development. However, due to the openness and virtuality of the network market, there are many problems in government supervision, such as false propaganda, fraudulent consumer behavior, improper operation and so on, which are all appendages of the rapid development of the network economy, and because of the network commodity traffic in China. Easy supervision started late, the foundation is relatively weak, and there are many problems in online commodity trading, there are many deficiencies in the supervision of online commodity trading, more confusion, unclear supervision responsibilities, investigation and evidence collection difficulties and other issues are becoming increasingly prominent, to a certain extent, hindered the development of online commodity trading market, is the legitimate rights and interests of consumers. Can not be guaranteed, affecting the development of the national economy and building a harmonious society.
As a law enforcement officer in the frontline of industrial and commercial administrative law enforcement, the author, from the perspective of industrial and commercial departments, analyzes the specific practices of the supervision of online commodity transactions in the administrative departments of industry and commerce, and, while drawing on the advanced experience and practices of foreign countries, combines the specific supervision situation to find out the problems existing in the supervision of online commodity transactions in China. It is feasible and practical to solve the problems existing in the supervision of online commodity trading by perfecting legislation, establishing the market access registration system of online commodity trading, strengthening training and other measures.
