【摘要】：船员权益保障的问题,是由船员的职业特殊性和行业的特殊行所决定的。文章对比了国内外内河船员发展过程中权益保障问题的现状,同时也对比了《中华人民共和国船员条例》实施前后我国内河船员权益保障标准执行情况：从船员收入、船员维权、法律地位、船员管理等方面变化情况,以量化的方式分析了内河船员权益保障,一是结合我国内河船员维权的意识的现状分析、维权的途经和手段研究；二是结合我国内河船员劳工的现状,认真分析我国保障船员权益的法律体系是否健全,《劳动法》和《中华人民共和国船员条例》的概括性规定是否具有可操作性和合理性,法规中的船员权益维护的主管机关的的责任和权力是否对,主管机关的干预手段的有效性；三是对保障船员权益的的一些公共政策、管理机构健全、管理体制完善方面进行分析,并对我国在实施《中华人民共和国船员条例》法规的力度和深度进行客观评价。借鉴一些船员维权的成功案例,针对我国内河船员劳工政策提出一些意见和建议,对《中华人民共和国船员条例》的实施细则进行政策上的分析和建议。首先从保障船员合法权益出发,积极探索如何培养和使用高素质船员,从而丰富人力资源管理理论。其次从多个角度分析我国内河船员保护政策的制定和实施,以及对政策效果评估讨论,从而丰富了公共政策分析理论。三对政府治理和部门的行政管理进行研究,从而丰富了行政管理理论。同时分析总结我国内河船员权益保障问题与当地经济发展和社会稳定的重要联系,运用系统管理理论、公共政策分析原理、公共管理论等对履约中遇到的问题进行研究分析。对提高《船员条例》在我国内河船员管理的实施力度和深度,建立完善的我国劳务市场规范机制,建立完善我国内河船员劳工权益保障体系等提出合理建议。
