我国公路工程监理中的寻租行为研究

【摘要】：公路工程的建设,关系到国家的发展、人民的安康,是一个国家必备的基础建设工程之一,公路工程的质量关系着民众的生命财产安全,直接影响着人们的出行。随反腐的深入与社会舆论的指摘,公共建设领域的寻租行为日益为社会所关注,公路建设作为直接关系民众生命财产安全的社会公共建设,必须遵循规范化发展,进行制度化建设,公路建设的过程、公路建设的质量理应并且必定会受到社会各界的注意与监督。公路、交通领域的一些行政官员前腐后继的腐败行为使人们深恶痛绝。所以,公路工程监理作为一项公路工程建设过程中的创新举措,对于实现公路建设的规范化具有重要意义。当人们对公路腐败行为深入思考之后,负责监理工作的公路工程监理公司也逐渐浮出水平,被推上风口浪尖。为了深入了解公路工程监理中的寻租行为,并找出予以防范的对策,本研究以媒体报道的H省公路工程监理存在的问题作为案例,首先,对寻租的定义进行了界定,同时也澄清了公路工程监理寻租的概念,将公路工程监理的寻租行为作为一种客观存在予以承认,进而在委托代理和层级代理理论上找寻寻租产生的原因,基于对公路工程监理寻租产生的原因分析,找出问题的根源。作为深入分析和实证的一个切入点,在综合网络搜索的基础上,对工程监理的系列腐败案进行案例剖析。根据文献的整理和自身工作的经历,对公路工程监理过程中出现的寻租,包括投招标阶段、公路建设阶段、工程验收阶段等全过程的寻租现象进行分析。找出现实中公路工程监理中寻租的主客观原因,包括工程监理的法律规章存在弹性空间、招投标竞争制度不健全、监理权限不到位,基层监理实施中存在很大的难度、公路工程监理制度不完善、基层监理人员自身能力与素质偏低,不能适应现代化公路建设等原因。根据对以上存在的问题的思考,提出了防范公路工程监理寻租和完善公路工程监理制度的一些对策和建议。进行顶层设计,从完善监理的相关法律法规着手,明确委托人、代理人、监理人三方的责任与义务,加强监理单位内部建设和监理行业的调整,建立一种能够反映市场规则的监理费用获取制度,通过对公路监理进行市场信用评估完善现代监理的企业制度等。通过对公路工程监理寻租的分析,找到问题的原因,结合相关的理论,直接提出解决问题的对策,为公路工程监理自身的完善带来一些启发。
[Abstract]:The construction of highway engineering relates to the development of the country and the well-being of the people. It is one of the necessary infrastructure projects in a country. The quality of the highway engineering relates to the safety of people's lives and property and directly affects the travel of people. With the deepening of anti-corruption and the criticism of public opinion, rent-seeking behavior in the field of public construction has been paid more and more attention by the society. Highway construction, as a social public construction directly related to the safety of people's lives and property, must follow the standardized development. The quality of highway construction should and will be paid attention to and supervised by all walks of life. The corrupt practices of some administrators in the field of roads and transportation are abhorrent. Therefore, as an innovative measure in the process of highway engineering construction, highway engineering supervision is of great significance to realize the standardization of highway construction. When people think deeply about highway corruption, highway engineering supervision companies, which are in charge of supervision, have gradually surfaced and been pushed to the top of the waves. In order to deeply understand the rent-seeking behavior in highway engineering supervision and find out the countermeasures to prevent it, this study takes the problems of highway engineering supervision in H province reported by the media as a case study. Firstly, the definition of rent-seeking is defined. At the same time, it clarifies the concept of highway engineering supervision rent-seeking, acknowledges the behavior of highway engineering supervision rent-seeking as an objective existence, and then finds out the cause of rent-seeking in the theory of principal-agent and hierarchical agent. Based on the analysis of the causes of rent-seeking in highway engineering supervision, the root of the problem is found out. As a breakthrough point of in-depth analysis and demonstration, this paper analyzes a series of corruption cases of project supervision on the basis of comprehensive network search. According to the collation of the literature and the experience of its own work, this paper analyzes the rent-seeking phenomenon in the whole process of highway engineering supervision, including the stage of bidding, the stage of highway construction, the stage of project acceptance and so on. To find out the subjective and objective reasons of rent seeking in highway engineering supervision in reality, including flexible space of laws and regulations of engineering supervision, imperfect competitive system of bidding and bidding, inadequate supervision authority, and great difficulty in the implementation of grass-roots supervision. The system of highway engineering supervision is not perfect, and the ability and quality of the basic level supervisors are on the low side, which can not adapt to the modern highway construction and so on. Based on the above problems, this paper puts forward some countermeasures and suggestions for preventing the rent seeking of highway engineering supervision and perfecting highway engineering supervision system. To carry out the top-level design, start with perfecting the relevant laws and regulations of supervision, clarify the responsibilities and obligations of the principal, agent and supervisor, and strengthen the internal construction of the supervision unit and the adjustment of the supervision industry, To establish a supervision cost acquisition system which can reflect the market rules, and to perfect the modern supervision enterprise system by evaluating the market credit of highway supervision. By analyzing the rent-seeking of highway engineering supervision, the causes of the problems are found, and the countermeasures to solve the problems are put forward in combination with the relevant theories, which will bring some inspiration to the improvement of highway engineering supervision itself.
