国外铁路监管机构探析

【摘要】：为推动我国铁路监管机构监管职责与监管手段的完善,剖析国外铁路的监管机构的设置形式、监管职责及监管手段。将不同监管机构的监管领域归纳为安全、市场和资金3类,阐述相应的监管职责;将监管手段归纳为法律类、管制类和信息类3类,分析不同监管领域的主要监管手段。在此基础上,结合我国铁路行业监管现状,提出加强监管机构组织建设、强化铁路宏观监管职能、创新监管手段等完善我国铁路监管的对策。
[Abstract]:In order to promote the improvement of supervision responsibility and means of railway supervision in our country, this paper analyzes the setup form, supervision duty and supervision means of foreign railway supervision agencies. The supervision fields of different regulatory bodies are classified into three categories: safety, market and fund, and the corresponding supervision duties are expounded, and the means of supervision are classified into three categories: law, regulation and information, and the main means of supervision in different regulatory fields are analyzed. On this basis, combined with the current situation of China's railway industry supervision, this paper puts forward some countermeasures to improve the railway supervision in China, such as strengthening the organization construction of supervision agencies, strengthening the macro supervision functions of railways, and innovating the means of supervision.
