农地确权、交易含义与农业经营方式转型——科斯定理拓展与案例研究

【摘要】:农地确权对农户生产性行为的影响受到学界广泛重视,但现有文献大多忽视了对确权所隐含的产权交易含义的研究。农地确权在提升农户产权强度的同时,有可能因土地的人格化财产特征而强化"禀赋效应",并进一步因"产权身份垄断"与"产权地理垄断"而加剧对经营权流转的抑制。研究发现,针对产权主体与产权客体不可分的交易约束,拓展科斯定理并通过产权细分、迂回交易及其有效匹配,能够在尊重农民土地人格化财产特征的前提下,实现农业的规模经济与分工经济。进一步的案例研究表明,以土地"集体所有、家庭承包、管住用途、盘活产权、多元经营"为主线的制度内核,有可能成为中国新型农业经营体系的基本架构。
[Abstract]:The influence of farmland right on farmers' productive behavior has been paid more and more attention, but most of the existing literatures have ignored the research on the implied meaning of property right transaction. At the same time, it is possible to strengthen the "endowment effect" because of the personal property characteristics of the land, and further intensify the restriction on the circulation of the management right because of the "monopoly of the identity of property right" and the "geographical monopoly of the property right". It is found that in view of the transaction constraints between the subject and object of property rights, the Coase theorem can be extended and the property rights subdivision, circuitous transactions and their effective matching can be carried out on the premise of respecting the characteristics of the personified property of the peasants' land. Realize the scale economy of agriculture and division of labor economy. The further case study shows that the core of the system, which is the main line of land ownership, family contract, management, property rights and diversified management, is likely to become the basic framework of China's new agricultural management system.
