【摘要】:住房消费信贷作为当前社会经济条件下产生的新事物,已成为国内住房消费者的主流购房方式,为房地产领域提供着主要资金来源。同时,由于市场需求猛增和住房消费信贷本身“量多事少”的特性,各商业银行也争相将住房消费信贷业务发展为主要资产业务。我国的住房消费信贷业务起步较晚,相对比较稚嫩,面临着大量的风险问题,集中表现为相关主体信用缺失、法律法规不健全、监管工作薄弱、银行内部防控存在漏洞等。因此,对这些问题进行仔细梳理,从而探讨住房消费信贷中银行风险的法律防范机制显得尤为必要,本文正是基于此点而写。 全文分为六个部分: 第一部分“引言”,以住房消费信贷市场为视阈,阐述住房消费信贷中银行风险法律防范机制的理论价值和现实意义,介绍国内外对该机制的研究现状,说明研究的侧重点、思路方法与创新之处。 第二部分“住房消费信贷中银行的风险概述”,阐述住房消费信贷的内涵,分析银行在住房消费信贷中面临的主要风险及该种风险的特殊性,为之后的研究提供理论基础。 第三部分“我国住房消费信贷中银行风险法律防范机制的现状分析”,分为两节,第一节探讨了住房消费信贷中银行风险法律防范机制的功能,凸显其重要性,第二节在介绍我国目前住房消费信贷银行风险防范机制现状的基础上剖析了其缺陷,银行在住房消费信贷市场面临的种种风险,都可追溯于征信系统不完善、法律法规不健全、监管工作不给力、内部防控不严密等防范机制的缺陷。 第四部分“国外住房消费信贷银行风险案例及其对我国的启示”对美国和日本的两次典型住房消费信贷银行风险案例进行梳理,与我国的现有住房消费信贷状况进行比较,分析产生风险的共同原因,得出启示。 第五部分“完善我国住房消费信贷中银行风险法律防范机制的对策和建议”从五个方面深入探讨了我国住房消费信贷中银行风险法律防范机制的完善。 第六部分“结语”,进一步凸出完善住房消费信贷中银行风险法律防范机制的重要性,并说明该问题的解决不是一蹴而就而是需要持久和不懈的努力。
[Abstract]:As a new thing produced under the current social and economic conditions, housing consumption credit has become the mainstream housing purchase method for domestic housing consumers, and it provides the main source of funds for the real estate field. Due to the rapid increase of market demand and the characteristics of "more and less" of housing consumption credit itself, commercial banks are also scrambling to develop the housing consumption credit business into the main asset business. The housing consumption credit business in our country started relatively late. Relatively immature, facing a large number of risk problems, concentrated on the lack of credit related to the main body, laws and regulations are not perfect, supervision is weak, there are loopholes in the bank internal prevention and control, and so on. It is particularly necessary to discuss the legal prevention mechanism of bank risk in the housing consumption credit. This paper is based on this point. The full text is divided into six parts: The first part "introduction", taking the housing consumption credit market as the visual threshold, expounds the theoretical value and practical significance of the legal prevention mechanism of bank risk in the housing consumption credit, and introduces the current situation of the research on this mechanism at home and abroad. Explain the focus of the study, thinking methods and innovations. In the second part, "Overview of Bank risk in Housing consumption Credit", it expounds the connotation of housing consumption credit, analyzes the main risks faced by banks in housing consumption credit and the particularity of this kind of risk. To provide a theoretical basis for the subsequent research. The third part is "the analysis of the present situation of the legal prevention mechanism of bank risk in the housing consumption credit in China", which is divided into two sections. The first section discusses the function of the legal prevention mechanism of the bank risk in the housing consumption credit. Highlight its importance, the second section introduces the current situation of housing consumption credit bank risk prevention mechanism based on the analysis of its defects, banks in the housing consumption credit market facing a variety of risks. It can be traced back to the defects of the credit system, laws and regulations, supervision, internal prevention and control. Part 4th, "the risk cases of Foreign Housing consumption Credit Banks and their Enlightenment to China", combs the two typical housing consumer credit bank risk cases in the United States and Japan. Compared with the existing housing consumption credit in China, the author analyzes the common causes of the risk and draws inspiration. In the 5th part, the author probes into the perfection of the legal prevention mechanism of bank risk in China's housing consumption credit from five aspects: the countermeasures and suggestions of perfecting the legal prevention mechanism of bank risk in China's housing consumption credit. The conclusion of the 6th part further highlights the importance of perfecting the legal prevention mechanism of bank risk in the housing consumption credit, and explains that the solution to this problem is not overnight but requires sustained and unremitting efforts.
