关于票据公示催告与除权救济法律适用若干问题研究

【摘要】：近年来,在审理呈快速上升之势的公示催告案件和票据纠纷案件的过程中,发现票据及其诉讼制度中存在许多问题,迫切需要统一认识和司法处理尺度。本文就其中几个问题进行了分析,对在现有法律框架内妥善处理相关纠纷,以及完善相关票据和诉讼制度提出了自己的看法和观点。
[Abstract]:In recent years, in the process of hearing public notice cases and bill disputes, which are rising rapidly, we have found that there are many problems in the bill and its litigation system. There is an urgent need to unify the understanding and measure of judicial treatment. This paper analyzes some of these problems, and puts forward its own views and viewpoints on how to properly deal with relevant disputes within the existing legal framework, and how to perfect the relevant bill and litigation system.
