论我国遗嘱信托制度的构建与完善

【摘要】：信托制度在我国建立已有许多年限,各类信托,尤其是合同信托在我国经济生活中得到了长足的发展。本文所研究之遗嘱信托,与合同信托最大的区别,就在于遗嘱信托是以遗嘱的方式设立的。我国立法比较系统地确立信托制度始于2001年信托法的制定,此后,信托事业在神舟大地上蓬勃发展,但在现实案例当中,遗嘱信托却难觅踪影。究其原因,就在于信托法及相关法律法规对遗嘱信托制度规定的模糊和不完善,同时,国内对遗嘱信托制度理论研究的也相对滞后。本文对遗嘱信托的研究,主要是从四个方面展开论述的。本文第一部分即主要从遗嘱信托与相关类似制度比较的基础上,阐述遗嘱信托产生的历史背景及传播,并介绍了该制度在英国、美国、日本及我国台湾等国家和地区的适用现状。同时,从现实的角度出发,提出在我国构建遗嘱信托制度的具有现实的必要性,并已具备相应的经济、观念和制度基础。第二部分主要从法律关系的构成要素方面的角度出发对遗嘱信托进行的剖析,阐述了遗嘱信托的基本原理。第一节主要论述了遗嘱信托相关当事人应当具备的条件的,第二节主要介绍了遗嘱信托客体之信托财产,分析了其法律性质、范围,并讨论了信托财产的独立性与同一性,第三节主要对遗嘱信托相关当事人的权利义务关系进行了介绍和分析。第三部分主要从制度内部安排的角度阐述了遗嘱信托的设立、变更和终止,并论述了对遗嘱信托自由的法律限制。第四部分主要为阐述我国构建完善的遗嘱信托制度的解决思路,并从实务的角度对适用遗嘱信托可能遇到的风险进行揭示。
[Abstract]:Trust system has been established in China for many years, and various kinds of trust, especially contract trust, have been developed greatly in our country's economic life. The greatest difference between testamentary trust and contract trust is that testamentary trust is established by will. The legislation of our country established the trust system systematically since 2001 when the trust law was enacted. Since then the trust business has flourished in the land of Shenzhou. But in the actual cases the testamentary trust is hard to find. The reason lies in the fuzziness and imperfection of trust law and related laws and regulations on the testamentary trust system, at the same time, the domestic research on testamentary trust system theory is also relatively lagging behind. This paper mainly discusses the testamentary trust from four aspects. The first part of this paper mainly discusses the historical background and spread of testamentary trust based on the comparison between testamentary trust and related similar systems, and introduces the system in Britain and America. Japan and Taiwan and other countries and regions applicable to the status quo. At the same time, from the point of view of reality, this paper puts forward the necessity of constructing testamentary trust system in our country, and it already has the corresponding economic, concept and system foundation. The second part mainly analyzes the testamentary trust from the angle of the constituent elements of legal relationship, and expounds the basic principle of testamentary trust. The first section mainly discusses the conditions that the testamentary trust parties should have. The second section mainly introduces the trust property of the testamentary trust object, analyzes its legal nature and scope, and discusses the independence and identity of the trust property. The third section mainly introduces and analyzes the rights and obligations of the parties involved in testamentary trust. The third part mainly expounds the establishment, change and termination of testamentary trust from the angle of system internal arrangement, and discusses the legal restriction on the freedom of testamentary trust. The fourth part is mainly to elaborate the solution of constructing the perfect testamentary trust system in our country, and to reveal the possible risk of applying testamentary trust from the practical point of view.
