房屋维修资金管理制度的研究

【摘要】:维修资金是专项用于房屋保修期满,共用部位和共用设施设备的维修和更新、改造,是保障房屋正常使用和保值增值的基础。维修资金制度是保持房屋完好率,提高和延长房屋的使用寿命,提高房屋使用安全系数的重要保障。因此,维修资金管理制度的设计、完善和实施,直接关系到城市居民的切身利益和社会和谐。我国房屋维修资金管理制度的建立已有十几年历史,在居民的现实生活中也起到非常重要的作用。但由于各种主客观原因,目前的制度建设还存在着许多瑕疵,以至于维修资金的归集和使用还不尽如人意。本文旨在进一步剖析现行的维修资金管理制度,并对修正该制度提出建设性意见。 房屋维修资金是为了解决房屋的物质缺损,为此本文从房屋物质形态变化规律入手,,研究房屋物质实体损坏的恢复和房屋维修的需求。然后再分析房屋维修资金制度的演变过程,把握维修资金制度建设对社会发展的推动作用,同时也能理解这些法规存在某些问题的原因。 通过对国外维修资金管理制度的比较和对现行维修资金管理制度的分析,找到了我国维修资金制度中存在着维修资金续交、申请使用手续、结构维修以及维修责任主体难寻等诸多问题。同时也提出了对某些法律法规的修改和对《物权法》司法解释的补充建议。本文还对公共政策绩效的评价进行了大胆的尝试,并试析了某个城市的维修资金管理制度的绩效。
[Abstract]:The maintenance fund is specially used for the maintenance and renewal of the common parts and facilities, which is the basis for the normal use and maintenance and increment of the house. The maintenance fund system is an important guarantee to maintain the perfect rate of housing, to improve and prolong the service life of houses and to improve the safety factor of housing use. Therefore, the design, perfection and implementation of maintenance fund management system are directly related to the vital interests of urban residents and social harmony. The establishment of housing maintenance fund management system in China has a history of more than ten years and plays a very important role in the real life of residents. However, due to various subjective and objective reasons, there are still many defects in the current system construction, so that the collection and use of maintenance funds is not satisfactory. The purpose of this paper is to further analyze the current maintenance fund management system and put forward some constructive suggestions for its amendment. The purpose of building maintenance fund is to solve the material defect of building. This paper starts with the change law of building material form and studies the restoration of material entity damage and the requirement of building maintenance. Then it analyzes the evolvement process of housing maintenance fund system, grasps the promotion effect of maintenance fund system construction on social development, and can also understand the reasons of some problems in these laws and regulations. Through the comparison of the maintenance fund management system abroad and the analysis of the current maintenance fund management system, it is found that the maintenance fund continues to be handed over in the maintenance fund system of our country, and the procedures for applying for the use of the maintenance fund are found. Many problems such as structural maintenance and maintenance responsibility are difficult to find. At the same time, it also puts forward some amendments to some laws and regulations and supplementary suggestions to the judicial interpretation of Real right Law. This paper also makes a bold attempt to evaluate the performance of public policy and analyzes the performance of maintenance fund management system in a certain city.
