【摘要】:周礼是一种不成文的习惯法,主体以传统周人共同体的古代习俗为基础,并部分吸收了夏商习惯法而形成的。这些不成文习惯法规范着周人的政治、经济、文化、生活等各种细节,一些青铜器铭文中所反映的土地交易、司法惩戒等活动都是周礼习惯法的具体判例。有的情况下,周王会任命掌管具体某项司法活动的人员,但更常见的情况是在王官之外,由各种名誉良好的领主根据习惯法进行仲裁,或者由当事人之间依据惯例自行调解。此外,周人对其它族群的习惯法表示尊重,即所谓"君子行礼,不求变俗",宋国、殷人、淮夷等不同族群也根据自己传统的习惯法进行自治。
[Abstract]:Zhou Li is a kind of unwritten customary law, the subject is based on the ancient customs of the traditional community of Zhou people, and partly absorbed the customary law of Xia and Shang. These unwritten customary laws regulate the politics and economy of Zhou people. Culture, life and other details, some bronze inscriptions reflected in the land transactions, judicial discipline and other activities are Zhou Li customary law specific case law. Zhou Wang will appoint persons in charge of a specific judicial activity, but it is more common for various reputable lords to arbitrate in accordance with customary law, in addition to the king's official. In addition, the Zhou people showed respect for the customary law of other ethnic groups, that is, the so-called "gentleman salute, do not seek to change the vulgar", Song, Yin people. Huai Yi and other different ethnic groups also according to their traditional customary law for autonomy.
