我国慈善组织商业化的治理问题研究

【摘要】:西方慈善商业化的运作模式日渐在世界范围内掀起潮流,随着经济社会的发展,我国越来越融入全球化潮流,慈善组织商业化发展如火如荼。我国慈善组织商业化的既成趋势不可阻挡,商业化在解决慈善组织面临的资源短缺困境和行政化弊端问题上显示出积极地成效,却也出现了公益腐败和过度商业化的异化现象。我国慈善组织商业化尚未形成共识,支持与反对者兼而有之,支持者对慈善组织商业化的创新探索赏识有加;反对者则对慈善组织商业化所加重的慈善丑闻苛责不断。究其根本,在于当前我国慈善组织商业化治理不善,商业化的发展现状对我国慈善组织的治理形成挑战。然而目前学界对我国慈善组织商业化治理的相关研究还非常薄弱,对慈善组织商业化的认识不够深入,缺乏系统性和前瞻性。针对当前研究的不足,本文立足于我国慈善组织商业化发展的现状,深入挖掘慈善组织商业化的本质及发展形态,力争对我国慈善组织商业化治理形成比较全面系统的研究,提出慈善组织商业化的治理之策,促使我国慈善组织商业化不断发展壮大。本文从慈善的双重属性(道德属性和经济属性)出发认识慈善组织商业化现象,认为我国慈善组织商业化转变是慈善的内在属性和外在环境共同作用下的产物。慈善理念的转变是我国慈善组织商业化变革最核心的触发因素,外在社会政治经济条件起到间接地烘托培育作用,而慈善组织自身的发展探索则是商业化的直接因素。在此基础上梳理我国慈善组织商业化的表现形态并分析其现实影响。进而以合作治理为理论基础,剖析我国慈善组织商业化异化现象的根源,并构建我国慈善组织商业化的合作治理之道。本文认为我国慈善组织商业化存在多重影响,既有着积极的作用也在一定程度上形成负面影响。我国慈善组织商业化治理理念滞后、治理的制度基础薄弱、治理的主体缺位等问题亟需完善。因此,主张合作治理作为慈善组织商业化治理的依据,搭建政府、慈善组织和社会合作治理的平台,明晰各治理主体的角色定位,完善合作治理的制度基础,解决当前我国慈善组织商业化出现的问题,促进我国慈善组织商业化健康发展。
[Abstract]:With the development of economy and society, our country is more and more integrated into the trend of globalization. The commercialization of charitable organizations is developing in full swing. The existing trend of commercialization of charitable organizations in China is irresistible. Commercialization has shown positive results in solving the problems of shortage of resources and administrative drawbacks faced by charitable organizations. But there is also the phenomenon of public corruption and excessive commercialization. The commercialization of charitable organizations in China has not yet formed a consensus, support and opponents of both, supporters of the innovative exploration of the commercialization of charitable organizations appreciated; Opponents, on the other hand, are constantly critical of the charitable scandals aggravated by the commercialization of charitable organizations. The fundamental reason lies in the current poor governance of the commercialization of charitable organizations in our country. The development of commercialization is a challenge to the governance of charitable organizations in China. However, the relevant research on the commercial governance of charitable organizations in China is still very weak, and the understanding of commercialization of charitable organizations is not deep enough. Lack of systematicness and foresightedness. In view of the deficiency of current research, this paper bases on the present situation of commercial development of charitable organizations in our country, and deeply excavates the essence and development form of commercialization of charitable organizations. To strive to form a more comprehensive and systematic study on the commercial governance of charitable organizations in China, and to put forward some measures to govern the commercialization of charitable organizations. This paper discusses the phenomenon of the commercialization of charitable organizations from the perspective of the dual attributes of charity (moral attribute and economic attribute). It is believed that the commercialization of charitable organizations in China is the result of the joint action of the inherent attributes of charity and the external environment, and the change of charitable concept is the most important trigger factor for the commercial transformation of charitable organizations in China. External social, political and economic conditions play an indirect role in fostering, The development and exploration of charity organization itself is the direct factor of commercialization. This paper analyzes the causes of the phenomenon of the commercialization of charitable organizations in China, and constructs the cooperative governance of the commercialization of charitable organizations in China. This paper holds that there are many influences on the commercialization of charitable organizations in China. The commercial governance concept of charitable organizations in our country lags behind, the system foundation of governance is weak, the main body of governance is absent and so on. We advocate cooperative governance as the basis for commercial governance of charitable organizations, build a platform for government, charitable organizations and social cooperative governance, clarify the role of each governance body, and improve the institutional basis of cooperative governance. To solve the problems of commercialization of charitable organizations in China and promote the healthy development of commercialization of charitable organizations in China.
