社会中间层公信力弱化的法律规制

【摘要】：我国经济政治体制改革的不断深入，为社会中间层主体的发展提供了条件，，涌现了大量的社会中间层主体，它们在政治、经济、文化等广泛社会领域中发挥着不可替代的作用。但是，社会中间层失灵也以多种形式表现出来，公信力流失就是其中重要的失灵现象，会影响到社会中间层的生存与发展，所以，防治社会中间层公信力流失，有效提升社会中间层的公信度是一个需要迫切解决的现实课题。 本文以社会中间层的涵义为突破点，引出当前社会中间层公信力流失严重的问题，然后，深度剖析了社会中间层公信力的基础，为提出提高社会中间层公信度的实施办法做好了铺垫。其次，描述当前我国社会中间层公信力流失的表现，这些表现为文章选题提供了现实来源。接下来，解析了致使社会中间层公信力流失的大部原因。除了政府的因素外，社会发展氛围也影响了其公信力，再加上组织的自律机制不完善，导致失信行为时有发生。文章最后部分，自然而然的明确了治理我国社会中间层公信力流失的措施——要完善我国社会中间层的法律监管。针对相关法律的现状，我们应当在立法取向上将社会中间层的角色定位为政府的合作伙伴，并制定社会中间层个体专门法；要大幅度降低成立社会中间层的准入标准，并最终对社会中间层的成立登记只实行自由设立制和登记报备制并行；同时进一步健全有关社会中间层结构治理的法律法规；与此同时，确立完善有关社会中间层信息公开的法律规制。
[Abstract]:The deepening reform of the economic and political system of our country has provided the conditions for the development of the social middle-tier subjects, and a large number of social middle-tier subjects have emerged. They are in the political and economic fields. Culture plays an irreplaceable role in a wide range of social fields. However, the failure of the middle layer of society is also manifested in many forms. The loss of credibility is an important failure phenomenon, which will affect the survival and development of the middle class of society. Therefore, preventing and controlling the loss of the credibility of the middle class of society and effectively promoting the credibility of the middle layer of society is a realistic subject that needs to be solved urgently. This paper takes the meaning of the social middle layer as the breakthrough point, leads to the serious problem of the loss of the credibility of the social middle layer, and then, deeply analyzes the foundation of the credibility of the social middle layer. It lays the groundwork for the implementation of the measures to improve the credibility of the middle stratum of the society. Secondly, it describes the performance of the loss of credibility of the middle stratum of our society at present, which provides a realistic source for the selection of the topic of the article. This paper analyzes most of the causes of the loss of credibility in the middle class of society. Besides the factors of the government, the atmosphere of social development also affects the credibility of the society. In addition to the imperfection of the self-discipline mechanism of the organization, the behavior of dishonesty occurs from time to time. In the last part of the article, Naturally, the measures to deal with the loss of credibility in the middle layer of our society are clearly defined-to improve the legal supervision of the middle class of our society. In view of the current situation of the relevant laws, We should position the role of the middle level of society as a partner of the government in the legislative orientation, and formulate specific laws for individuals in the middle of society; we should substantially reduce the standards of entry for the establishment of the middle class of society. In the end, the establishment and registration of the middle class of society should be accompanied only by the system of free establishment and registration and reporting; at the same time, the laws and regulations concerning the governance of the structure of the intermediate layer of society should be further improved; at the same time, Establish and perfect the legal regulation of the disclosure of information in the middle of the society.
