基于生命周期理论的监狱突发事件应急管理研究

【摘要】：新中国成立后，尤其是改革开放以后，中国的政治经济快速发展，社会转型期也被压缩，各种矛盾和问题也集中式的爆发出来，大部分突发事件呈现出了爆发频率高、构成复杂、波及范围广、社会影响剧烈等特点，严重的损害了人民群众的切身利益，干扰了正常的社会经济秩序，损害了政府的公众形象，对我国的社会经济发展直接的构成威胁，给社会带来不良后果和影响，妨碍和谐社会的构建。监狱是我国重要的刑法执行机构，是关押犯罪分子的重要场所，与其他组织机构相比，监狱场所有着一定的封闭性，新时期，随着监狱罪犯构成和狱情犯情的变化，监狱成为社会各种矛盾的汇集地和交织点，存在着许多的突发事件征兆，这大大增加了监狱突发事件的可能性。监狱突发事件发生，具有极强的破坏力，对民众心理和社会造成的负面影响很大。一直以来，各级监狱高度重视突发事件的应急管理工作，但由于历史和现实的原因，从整体上看，我国监狱突发事件的应急管理理论研究和实践研究上，不能够满足新时期监狱应急管理需求，本文正是基于这一现实问题，以生命周期理论为基础，将突发事件分成孕育期、突发期、蔓延期和恢复期四个阶段，结合前人的研究、现实案例以及本人的工作经验，找出监狱突发事件应急管理工作开展的现状，从四个阶段找出了监狱突发事件应急管理中的预案管理水平不高、信息管理能力不强、舆论管理疏导不畅和心理干预工作滞后的问题，同时从思想意识薄弱、法律保障不完善、管理主体单一和应急资源短缺四个方面分析了问题的原因，最后通过对国外理论和实践经验的借鉴，结合文章构建的理论模型，，从监狱突发事件应急管理的基本原则、构建监狱突发事件应急管理体系、提供外部支持三个大的方面给予了对策建议，以期能够给监狱突发事件应急管理工作提供一些理论参考。
[Abstract]:After the founding of New China, especially after the reform and opening up, China's political and economic development was rapid, the social transition period was also compressed, a variety of contradictions and problems also erupted in a centralized manner, most of the emergencies showed a high frequency of outbreak. The characteristics of complex composition, wide scope and severe social impact have seriously damaged the vital interests of the people, interfered with the normal social and economic order, and damaged the public image of the government. It poses a direct threat to the social and economic development of our country, brings adverse consequences and influences to the society, and hinders the construction of a harmonious society. Prison is an important criminal law enforcement organization in our country and an important place to hold criminals. Compared with other organizations, prison facilities have a certain degree of closeness. In the new period, with the changes of the composition of prison criminals and the situation of prisoners in prison, Prison has become a collection of social contradictions and intertwined points, there are a lot of unexpected symptoms, which greatly increased the possibility of prison emergencies. Prison emergencies have a strong destructive power, and have a great negative impact on people's psychology and society. For a long time, prisons at all levels attach great importance to the emergency management of emergencies. However, for historical and practical reasons, on the whole, the theory and practice of emergency management in prisons in China are studied. Based on the theory of life cycle, the emergency events are divided into four stages: gestation period, emergency period, spreading period and recovery period, based on this realistic problem, this paper combines the previous studies, which can not meet the needs of prison emergency management in the new period. This paper finds out the present situation of the prison emergency management, and finds out from the four stages that the management level of the emergency plan is not high and the ability of information management is not strong. At the same time, the causes of the problems are analyzed from the following four aspects: weak ideology, imperfect legal protection, single management body and shortage of emergency resources. Finally, through the reference of foreign theory and practice experience, combined with the theoretical model constructed by the article, from the basic principles of prison emergency management, the prison emergency management system is constructed. In order to provide some theoretical reference for the emergency management of prison emergencies, three aspects of external support are given.
