我国反洗钱个人客户身份识别的政策研究

【摘要】:随着社会经济的快速发展,我国市场经济逐步与全球经济体系不断融合,金融服务方式不断创新,各种资金通过金融结算在跨国、跨地区之间转移。现代金融的国际化决定了洗钱犯罪也具有国际化的特征。洗钱活动的日益猖獗对世界政治、经济都造成了极大的影响,成为滋生贪污、走私、贩毒、恐怖等犯罪行为的温床,反洗钱已经成为世界各国政府关注的重点,是政府治理中不可缺少的一个重要环节,对维护一个国家的政治稳定、经济秩序、百姓生活都有着十分重要的意义。在世界各国的反洗钱立法及国际反洗钱标准中,客户身份识别制度、大额与可疑交易报告制度、客户身份资料和交易记录保存制度是国际公认的洗钱预防措施的三项基本制度,这也是金融机构应该履行反洗钱责任的基本义务。客户身份识别是金融机构反洗钱的基础环节,也是金融机构反洗钱的难点。因此,作为政府管理部门的人民银行和银监会出台了围绕客户身份识别的一系列监管政策。本文选择人民银行和银监会出台的关于个人客户身份识别政策作为研究对象,对反洗钱个人客户身份识别政策的内容及执行效果进行研究。本文首先围绕客户身份识别政策的制定过程、政策要求、政策执行情况、政策执行效果等进行了全面研究,并从监管范围、监管对象、监管程序、监管依据等方面对现有的客户身份识别政策进行分析;然后,本文对目前金融机构落实客户身份识别相关政策中存在的问题与原因进行探讨,对监管政策的有效性进行分析;最后,笔者从个人账户信息的完善、建立政府间各部门信息的共享机制、严格落实实名制以及个人账户管理政策的改善等方面提出进一步完善客户身份识别政策的建议。
[Abstract]:With the rapid development of social economy, China's market economy and the global economic system continue to merge, the financial service mode is constantly innovating, and all kinds of funds are transferred between transnational and cross-region through financial settlement. The internationalization of modern finance determines that money laundering crime also has the characteristics of internationalization. The increasingly rampant activities of money laundering have had a great impact on world politics and economy. They have become hotbeds of criminal acts such as corruption, smuggling, drug trafficking, terrorism and so on. Anti-money laundering has become the focus of attention of governments all over the world. It is an indispensable important link in government administration, which is of great significance to the maintenance of a country's political stability, economic order and people's life. Among the anti-money laundering legislation and international anti-money laundering standards in the world, customer identification system, large value and suspicious transaction reporting system, customer identity information and transaction record keeping system are three basic systems of internationally recognized prevention measures for money laundering. This is also the basic obligation of financial institutions to carry out anti-money-laundering duties. Customer identification is the basic link of anti-money laundering of financial institutions and the difficulty of anti-money laundering of financial institutions. Therefore, the people's Bank and the Banking Regulatory Commission, as government management departments, have issued a series of regulatory policies around customer identification. This paper chooses the personal customer identification policy issued by the people's Bank of China and the Banking Regulatory Commission as the research object to study the content and implementation effect of the anti-money laundering personal customer identification policy. Firstly, this paper makes a comprehensive study on the process of making customer identification policy, policy requirements, policy implementation situation, policy implementation effect and so on, and from the scope of supervision, the object of supervision, the supervision procedure, etc. Then, this paper discusses the problems and reasons existing in the implementation of the relevant policies of customer identification by financial institutions, and analyzes the effectiveness of the regulatory policies. Finally, the author puts forward some suggestions on how to improve the customer identification policy from the aspects of the perfection of personal account information, the establishment of information sharing mechanism among different government departments, the strict implementation of real-name system and the improvement of personal account management policy.
