投资者保护:适当性制度之恪守与超越

【摘要】：现代意义的风险,借由西方工业文明产生,进而在全球范围内大肆扩展。风险既包含了政治、经济、文化,也涵盖了社会、教育等人类社会的各个领域。当前的中国经济,存在风险增多、问题复杂、增长乏力等问题。而由资本市场、资本投资带来的投资风险,会借助金融市场的放大效应进一步影响整体经济的表现。本刊组织本组专题,借由经济、法律领域的风险为始,分析对外投资风险的规避、投资者的制度保护以及"三农"领域内信贷担保等内容,分别就风险、投资与保护的内容进行解读。如陶斌智等提出,我国当前对外投资规模日益扩大,在此背景下,构筑健全的政策性海外投资保险制度,是有效规避世界范围内政治与经济风险的必要手段,并就此问题进行了深入分析。曹胜亮认为,我国金融市场领域内投资者适当性制度存在效率差、结构单一等问题,需要在借鉴发达经济体投资者适当制度的基础上,构筑完备的、适合我国国情的投资者适当性制度。雅玲等人提出,我国当前农村金融市场的发展问题重重,尤以农村的信贷担保问题表现突出,它直接带来了"三农"领域内的金融和社会风险,因此需要有效解决我国农村的信贷担保问题。投资、风险与保护是现代市场经济永恒的主题之一,我们的研究只是沧海一粟,希望通过本组专题能够抛砖引玉,就风险及其化解等问题求教于专家,以此为我国市场经济风险的制度防范提供些许参考。
