佛山市建筑施工企业工资支付保证金制度问题研究

【摘要】：建筑施工企业工资支付保证金制度是一项预防和化解建筑施工企业拖欠工人工资的制度。该制度规定建筑施工企业在签订了工程施工承包合同后,必须在商业银行预先设立专用账户,由建设单位或施工总承包企业作为支付责任主体,从工程款中先行拨付一定比例的资金存入银行专用账户,以确保企业按时足额发放工人工资;当建筑施工企业拖欠工人工资且同时符合提取工资保证金的条件时,人力资源社会保障行政部门联同建设行政主管部门通知有关商业银行,按照工人被拖欠工资的数额,动用企业存储在银行的保证金拨付到工人的个人账户,以兑现被拖欠的工资。建立建筑施工企业工资支付保证金制度,有助于约束建筑施工企业按时足额支付工人工资,确保建筑工人一旦被拖欠工资能得到及时的救济,避免因建筑施工企业拖欠工资而引起群体性事件,一定程度上能起到维护社会和谐稳定的作用。但在现实中,佛山市的建筑施工企业工资支付保证金制度仍存在方方面面的问题,影响了制度的实施效果。笔者根据选题的意义,阅读有关建筑施工企业工资支付保证金制度的文献资料,了解国内相关研究成果,并运用文献研究法、实例研究法以及分析归纳法,通过分析佛山市工资保证金制度的现状、问题和原因,借鉴和对比广东省珠三角城市以及河北省的相关制度或有益经验,进行深入的探索研究,结合佛山市的实际,提出改进完善的思路和设想。为了行文的方便,笔者在文中将“佛山市建筑施工企业工资支付保证金制度”简称为“佛山市工资保证金制度”。
[Abstract]:The system of wage payment margin for construction enterprises is a system to prevent and resolve the arrears of workers' wages in construction enterprises, which stipulates that construction enterprises should sign contracts for construction projects. A special account must be set up in advance in a commercial bank, and the construction unit or the construction general contracting enterprise shall act as the principal part of the payment responsibility, and a certain proportion of the funds from the project shall be deposited into the bank special account in advance. To ensure that enterprises pay workers in full and on time; When the construction enterprise is in arrears with the workers' wages and meets the conditions of drawing the salary margin, the administrative department of human resources social security shall, together with the construction administrative department, notify the relevant commercial banks. According to the amount of the worker's wages in arrears, the deposit deposited by the enterprise in the bank is used to be paid to the worker's personal account in order to realize the defaulted salary. It is helpful to restrain construction enterprises from paying workers' wages in full and on time, to ensure that construction workers can get timely relief once their wages are defaulted, and to avoid mass incidents caused by construction enterprises' arrears of wages. To a certain extent, it can maintain social harmony and stability. However, in reality, there are still many problems in Foshan construction enterprise wage payment margin system. According to the significance of the topic, the author read the documents about the salary payment margin system of construction enterprises, understand the relevant domestic research results, and use the literature research method. Through the analysis of the current situation, problems and reasons of the wage margin system in Foshan City, the author draws lessons from and compares the relevant systems or beneficial experiences of the Pearl River Delta cities in Guangdong Province and Hebei Province. Carry on the thorough exploration research, combine with the reality of Foshan City, put forward the thought and the idea of improving and perfecting, for the convenience of the writing. In this paper, the author calls "Foshan construction enterprise wage payment margin system" for short "Foshan salary margin system".
