电视节目模板网络分享场域的版权保护机制研究

【摘要】：网络分享下电视节目模板的版权保护面对着前所未有的困境和难题,相对于传统的电视节目制作和播出环境,网络平台从节目制作的主体、视频节目的内容形态到视频节目的传播方式都发生了翻天覆地的变化。面对网络平台花样百出的节目模板侵权行为,电视节目模板的版权拥有者无论是对版权重新界定,还是对权益的司法追诉,都不得不适应新的环境和语境。本文选择场域理论作为研究视角,从电视节目模板生成和运行的场域、网络分享场域的电视节目模板的新特征、网络分享环境下的节目模板侵权、节目模板网络分享侵权行为的追诉和网络分享中的版权保护等个五个层面来探究网络分享环境下电视节目模板版权保护机制的建构路径。
[Abstract]:The copyright protection of TV program template under the network sharing is facing unprecedented difficulties and difficulties. Compared with the traditional television program production and broadcast environment, the network platform starts from the main body of program production. The content form of the video program to the transmission mode of the video program has undergone earth-shaking changes. In the face of the infringing behavior of the network platform, the copyright owner of TV program template has to adapt to the new environment and context, whether it is the redefinition of copyright or the judicial prosecution of rights and interests. This paper selects the field theory as the research angle, from the television program template generation and the running field, the network sharing field television program template new characteristic, under the network sharing environment program template infringement, This paper probes into the construction path of the copyright protection mechanism of TV program template under the network sharing environment from five aspects: the prosecution of the infringement of the network sharing and the copyright protection in the network sharing.
